Currently, I am separated from my husband who came here on a fiancé visa. We got married in 2008. He had a temporary GC that expired on 2010. He left for his country in 2010 because we did not get along. However, he returned and filed for divorce because of the need to be able to file for a waiver from joint filing. As I understand it he had 87 days to provide a divorce decree. However, to this date (a year later) divorce is not finalized. His attorney refuses to provide update on his immigration status. I think, as his sponsor with legal obligations toward US government, I have a right to know about his immigration status. How can I get this information from BCIS?

The answer is not one that you will like. You aren't entitled to information regarding his status.

You can't get any information about his immigration status, but I can tell you that he is a lawful permanent resident until a judge says otherwise. Since the divorce is not final, your husband's attorney will have petitioned the court to suspend any proceedings against your husband until his divorce is final, he had a chance to submit the divorce decree to the USCIS, and they had a chance to adjudicate it. If the USCIS finds that your husband entered the marriage in good faith, he will receive an unconditional, 10-year Green Card.
