Hello everyone, i am so worried now coz my fiance (the petitioner) sent the rfe response yesterday to the USCIS. OUr RFE is the G-325A of the Petitioner because my fiance overlooked to sign the form and was not able to fill up the box on the bottom part of the form so he submitted a new copy but the problem is my fiance was confused about the item File Number A____________, on our RFE notice of Action, the USCIS assigned already an A# so my fiance put that particular number on the File Number Item which it should be NONE coz he is as US Citizen. Would it be a problem? What shall we do? Call the USCIS once they received our RFE reply and explain to them about the typo error? Any advise and insights from you guys is a BIG Help. Thank you very much to those who will answer.

Is your fiance a citizen by birth or naturalization?

If he listed an Alien registration number by mistake and you get a RFE, just respond to it.

Not signing the 325 is a Automatic rejection at the bottem of the page. At the Right hand corner at the bottom for a Alien # it should be None. That what I remember. I think the mistake was not signing it. Of course its going to be rejected. Am I correct or please advise.

Is your fiance a citizen by birth or naturalization?

My fiance is a citizen by birth, my fiance got confused about it because from our rfe notice there was an A# assigned already to our case so he listed it to the new G-325A that he just submitted to the USCIS as our RFE response... argghhh! i don't want another rfe.

I do not think it will be a problem.

Good news! You will not get another RFE. They only send ONE. Obviously he mistakenly filled in something not applicable to him, since this does not apply to a US citizen whatever he puts there is NA.

Actually it is not, G-325a's do not even need to be signed AT ALL. Not signing the I-129f is an automatic rejection but then there would be no RFE.

If they get a denial after this their defense to re-open the case is that they should never have received an RFE at all. See below. If it was rejected for a lack off signature ONLY this is a mistake by an untrained adjudicator, however once made the ONLY option is to respond to an RFE, you cannot "take back" an RFE.

G-325A for Petitioner and/or Beneficiary is not Signed and/or Photos not Submitted.

Purpose

To provide field offices with guidance on processing Form I-129F petitions when the accompanying G-325A is missing signatures and/or photographs.

A properly executed Form G-325A is required for all I-129F petitions. Previously it was standard practice to issue an RFE when the beneficiary failed to sign the G-325A and/or failed to submit photographs. From the date of this memorandum, an RFE should not be issued in instances where the beneficiary failed to sign the G-325A and/or failed to include photographs provided that the beneficiary is residing abroad. The beneficiary will be required to sign the Form G-325A and/or submit photographs at the time of visa issuance abroad. It is also not necessary to RFE for the petitioner’s signature on the G-325A, if the petitioner failed to sign it. The signature of the petitioner on the Form I-129F should be deemed sufficient for purposes of adjudicating the petition. Finally, it is important to note that the petitioner’s photograph is still required for the adjudication of the I-129F, so if it is missing, it must be requested prior to adjudication.

Questions regarding this memorandum may be directed through appropriate channels to Mica Pilz of Service Center Operations.

That's the reason why we got RFE because my fiance failed to sign the G-325A so my fiance sent the signed and complete G325 but then he put the A# to the item File Number A_____ which it should be NONE.

Ohhh thank you, i am relieved somehow...i think the A# assigned to our case is my A# once the petition is approved. my fiance thought it was our file number so he mistakenly put it on that item.

A G-325-A does not have to be signed ? ... A properly executed Form 325 is a biological Form attesting to background. It is required to be signed just as the 129-F and In the Letter of Intent depending on the Petition. SIGNED in Ink. Dated.

See the signature and date at the bottom of the form where you should sign. On the G-325-A Form for each party. Who brought up pictures. No mention from the OP passport style pictures were not included. Maybe.
