Hello am really new here and need some help. Am a USC and trying to get my fiancee here.We met and got engaged whiles i was separated and got divorced in september. Am planning on going to marry here and will like to know if K1 will be better and faster than I-130. Please give me some advise if my separation and bn engaged to her will cause any problems if we file for K1 visa.Thanks

Becoming engaged while married can be a red flag, yes. This is particularly true in such a high fraud region of the world as sub-saharan Africa.

Yes it is a red flag. How much depends on several factors:

- are you a born or naturalised citizen? If naturalised, did you get citizenship through your first wife?

- How long were you separated?

- How did you meet your now fiancee?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Even though i was separated for over a year and divorced.Dont have legal separation papers but in my state u have to be fully separated for at least a year before the divorce will be granted.will they accept a letter from my ex-wife?or you think its best i go ahead and marry her and file the I-130? please advise thnx for ur previous response.

was separated since 2009 and divorced in September 2011 i met my fiancee in dec 2010 and hv bn there to c her 2 times..will it be advisable if i get her married and file for her?

You'll want to think this through with full knowledge of all factors including the time difference. Ghana has at least an additional year backlog for immigrant spouse interviews. I don't know what the backlog is for a fiancee visa. Check in the Regional forum if nobody answers here.

The strongest evidence of a bona fide relationship is always the documentable time you spend together in person. Regardless of which way you go, I would advise you to include an Evolution of Relationship Letter with your petition. You can explain the separation and divorce issues in that letter as well.

hey thanks for responding to my questions i went to Ghana and spent 2 months there and went back again in May for the engagement..we had a party and took lots of pictures with her family and my family and kids in it. we got joint checking accounts step up there in Ghana got detailed call logs, emails, skype i sent her money through western union a couple of times and sent her packages etc..all these infor i kept copies..Am planing on going back to Ghana this jan, and my dilemma is to go ahead and marry her and mail the I-130 to be files here because i will be there for 3 months..but was contemplating if i should go ahead and file the K1 visa and at least get a 2 month advantage and against waiting after jan.What do u think with this infor provided.

Sounds like you don't know the differences in the timeline yet. When you know that, your decision will be a more informed one. Please don't duplicate your public questions in Personal Messages. It doubles the work of responding and is inconsiderate.
