HElp!!!

JUst got married 11/11/ 2011 and getting AOS ready to go I Need to wait until I get the marriage Certificate But what I need to know is she decide not to bring her sone here with her and will leave him in China for a few years to learn, So should I still put him on form I-485 and mark ( apply with you) He is on the K-1 visa but did not go to the interview with her at the time she took hers

Congratulations Len!!

As far as I know, you should list your wife's son on Page 2 Part 3 Section B, although her son has to have his own AOS after he enters the US with his own K-2 visa within one year of your wife's k-1. If he comes after the 1-year window, then it is a different process altogether.

any DS-230 submitted on him for a K-2 visa, or no?

if no, then you really need to think about this, as 'his age' drives yer choices.

choices, as I undertand them:

1. file a K-2 FTJ case with GUZ IV soonish (within 9 months of 2011-07-05) or

2. YOU file an I-130 on the son to USCIS chicago lockbox.

NO - he is not in USA, he not arrive on a K-2. Even if he did, he'd need a seperate I-485 document, filed with the mother's.

All is going well for us My new wife is adjusting well so far I will try to sort out things about the visa for her son to come here, He is only 5 years old and we want him to learn chinese characters and etc while he is young then bring him here. He was included on the K-1 visa but we did not take him to the interview with us, We were married on 11/11/11 Here in the USA and now are doing our AOS Oh and I think my wife is Pregnant so travel will not be good for her next year, So we will have to file a diffrent visa for him later I will send a letter to GUZ and explain the situation after we decide if and when to bring him but I am sure it will be 2 years

ok - smells like an I-130 filed by you, a bit later.

You could file one nowish, stall at NVC for up to a year,

then ask for delayed interview date, and NOT USE EP processing at NVC.

That'll keep something in play, and you have lots of time.

Congratulations Len and Yaqin!!

It's a good idea for the 5-year old to stay and learn Chinese for a couple of years, but I'm sure the separation is tough too.

By the way, I want to clarify what I said about Yaqin's son's name on form I-485. I think regardless of what you file for him later, form I-485 for Yaqin's AOS asks for her present husband and children's names, so that's why I said to fill in the 5-year-old's name. Your name should be on her form I-485 as well :)
