Missed teh CR1 interview

Guy's i need help .

I had applied for my wife's CR-1 in 2009 and the interview was scheduled in march 2010 . Due to my family obligation had to come back to my native country of Nepal and am living with my wife .Since i was back , i did not worry much about the interview and missed the date . I did not try and check back thinking after 1 yr it expires automatically and the application will nulled .

This year i was planning to take a visit with my wife and had her apply for tourist visa so that we could visit a few family in US for x-mas and new yrs . To my horror , when my wife sat for the interview ,the counselor said that she had applied for CR-1 visa and is not eligible for a tourist visa . Asked her to apply for the visa again .

I am completely taken by surprise .1 yr and the vr-1 should have expired , but some how it seems i missed something on this . i checked the NVC papers and it clearly states about the 1 yr clause .

Has someone run into the same situation ? Any idea's whats happening and what course of action should i be taking . I am not planning to move back to US for next 2 yrs , but somehow it seems i just locked my self up with filing the petition .

Help plz .

It's 1 year if you keep in touch with them. It sounds as though you did not do this. In addition to not keeping in touch, you missed your interview without prior notice. I'm sure they would've rescheduled for you. Your best bet is to start the process ALL over again.

Your best bet is to start the process ALL over again.

OP, before you start the process over again by refiling, you need to check the status of your current petition with USCIS to see if they have revoked it or not. If the petition is inactive at the NVC, you may be able to reactivate it by paying the fees again (yes, you will have to pay the fees again).

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

That means all NVC intake was done, already. no '1 year span' for you, at all.

Suggest you call into NVC, nowish, get status of the casefile.

then, call in to DoS Hotline, get status of the casefile.

It may be (rarely) that she needs to request a new interview date with the IV unit (where ever the interview is to take place) and ask them that the casefile be forwarded to the IV unit (Consulate, NVC, unsure of who has it now)

or

file an I-824, get the ball rolling again.
