Question regarding I-864

We're currently filling out the I-864 and we had some questions as to how and when my wife's income starts to count, but I'll elaborate:

We resided abroad in The Netherlands from 2008 until September of 2011, when my wife relocated back to the USA after filing I-130 and after she had completed her studies to seek employment and establish domicile. As of the start of October my wife has been employed and her pay is more than adequate the meet the guidelines established in I-864P for a household of 2 in the contiguous 48 states. Prior to the job she started in October of this year she had only been employed on various internships while she completed her studies here in The Netherlands and what she earned from these internships did not meet the guidelines in I-864P. If we take the total amount she earned in 2011 at her internships along with her current job it just meets the minimum if we use gross pay, not net.

So more or less my questions are:

- What do we put down for her individual annual income, what she can expect to earn at her job if she worked there for a full calendar year or what she actually took home as pay this year?

- Do we use gross pay or net pay?

- Will it be an issue that she has only been employed for a 1 1/2 months to 2 months when we file the I864 and state her income? Is there a certain metric used here to determine when the income counts, when it does not?

Hi,

I was in a situation similar to that.I explain you what i did, but it doesn't mean that you can not send I-864 rightaway. I waited five months after my employment date to make sure that it will be above the poverty line.then when i filled out I-864 (re-filled it since once i filled it out but i was not working so they didn't accept it, eventhough the assets were enough), I sent my 5-month paystubs.I asked from my employer to give me a letter showing my annual gross salary & when i filled out I-864, i put the same annual gross salary that that letter stated even though i had worked just for five months there. I sent I-864 at the end of this September & NVC didn't complain this time.

Co-sponsor will not be necessary, I have plenty of assets to support us.

It's more of a question of how we are supposed to fill in her section regarding income as the wording in the instructions and the step by step is a bit vague.

Take your current weekly or bi-weekly or half-monthly income and multiply it by either 52 or 26 or 24 and that is your current annual income. The income for 2010, 2009 & 2008 are what you have as per your federal tax returns. File I-864 as it has the option to show the assets.

USA

01/08/13 - Approved and GC is order for production on 1/8/14

09/12/13 - Case transferred to CSC. NOA2 received on 09/18/13

08/30/13 - Biometrics Done - No walk ins allowed at this LSC (received on 8/16/13).

08/05/13 - NOA1 (received on 08/10/13)

08/01/13 - Mailed I-751 (received on 8/2/13 - check cashed on 8/5/13)

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)
11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.
