Greetings,

I am currently in a situation I really need your help people. I am married to a US citizen woman in Haiti my country, july 30th 2011. We recently sent the I-130 package to USCIS( november 9th 2011) to start the CR1 and we are waiting for NOA1.I was just talking to my wife over the phone we love each other so much that we want to be together in less than 3 month which CR1 surely can not guarantee. My wife last october and spent 17 lovely and romantic days with me. I did not want to let her go back to the US but she was obliged too. Now she is pregnant and we can not live far anymore. The situation is hard to live mainly when you in love and faithfull. What are the chances for me to obtain a tourist visa if I request one at the embassy in my country while I am on CR1 ? 2- if it happen that I obtain a tourist visa, will I be able to stay on it in the US, withdraw the CR1 case and apply for AOS? Plz people let me know, very urgent

What are the chances for me to obtain a tourist visa if I request one at the embassy in my country while I am on CR1 ?

The chances of you obtaining a tourist visa from Haiti being married to a USC and having a CR-1 petition pending are next to nil.

2- if it happen that I obtain a tourist visa, will I be able to stay on it in the US, withdraw the CR1 case and apply for AOS?

That's a non-starter, entering on a tourist visa with the intent to stay and adjust status is fraud.

September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Just don't do it, i.e. going on a B2 (tourist) visa and AOS-ing while in the US.

December 2009 -- Visit to Malaysia.

February 2010 -- Applied for B2 visa, approved.

March 2010 -- Visited US.

April 2010 -- Returned from US.

May 2010 -- Sent in K1 Visa application.

July 2010 -- Received NOA2 in 71 days from NOA1.

July 2010 -- Packet 3 received.

August 2010 -- Cancellation of K1 Visa application.

I wish I could say yes you can do that but honestly YOU WILL PUT YOURSELF IN A LOT OF TROUBLE AND MORE RISK OF YOU GUYS NOT BEING ABLE TO BE TOGETHER AT THE END. KNOW THAT THE U.S. GOVERNMENT KNOWS THAT YOU GUYS ARE MARRIED NOW AND IF YOUR INFO COMES UP THEY WILL ASK QUESTIONS. HOPE THIS HELP

Don't apply for Tourist VISA while your CR-1 application is under process. Of course, this CR-1 process would take the time around 7-9 months to get the VISA in your hand if everything is on track. But this wait is worth.
