I 864, affidavit of support question

good day Vjers,

just wanna ask regarding the ITR of my husband because we dont know which to put and follow on the form I-864, on 2008 and 2009 he had declare with his previous wife.. and her sister.. and on 2010 her ex wife and him file for seperate ITR, i am not sure about what it is written but he showed me and that's what i understood, it is on the upper portion of the page and saying seperation of ITR and so on.. dont know what follows.. and still declare his sister and now my question is.. are we still gonna put the ex wife on the number of household? the are divorce already.. and is that gonna be a problem on our NVC processing and to my interview soon though we dont have a date yet? im just so worried about it..

and please explain what about the seperate ITR.. i dont understand.. hope to hear from all of you.. thank you.

go to uscis.gov, click on forms...then I-864, click on Instructions on filling out the form.

it says there, household includes him, you, dependent children, other dependents listed on his last income tax return and any immigrants he previously sponsored in an I-864 form that he is STILL OBLIGATED TO SUPPORT. ask your husband what the final divorce decree says about his obligation to support the ex-wife or if that ex-wife is now a US citizen, in which case her name does not need to be included.

10-06-2008 Received my AP...yehey, i can go back to Phil for xmas!

11-14-2008 DMV driving test-passed! thank you Lord!

11-18-2008 Received RI driver's license

11-30-2008 Went home to PHILs for the holidays

12-21-2008 Church wedding!

01-08-2009 AOS Approved! thank you Lord! no interview required!

01-16-2009 Received GC in mail

09-02-2010 Sent out application for ROC

09-08-2010 Received NOA1

09-10-2010 Received Biometrics Notice

10-06-2010 Biometrics

12-06-2010 Approved! Thank you Lord God!

12-11-2010 Received NOA2 and 10-yr GC in the mail =)

they are divorce already, and i have a copy of the divorce decree and it doesnt say anything about support or what.. the decree is DISSOLUTION. and that's it.. what i want to know if he still needs to put it in the number of household where in fact they have a separate ITR for the recent year 2010..which was mentioned on the ITR on the 2010 the name and of the ex wife and seperate tax something..

If he filed CR1 or K1 visas and brought his ex-wife to US and if the period is less than 40 quarters or if she hasn't yet become a US citizen by now, then she will have to be included.

09/12/13 - Case transferred to CSC. NOA2 received on 09/18/13

08/30/13 - Biometrics Done - No walk ins allowed at this LSC (received on 8/16/13).

08/05/13 - NOA1 (received on 08/10/13)

08/01/13 - Mailed I-751 (received on 8/2/13 - check cashed on 8/5/13)

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)
11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.
