Our daughter all ready has a priorty date and she is currently over 21 and unmarried. If our daughter has a baby but is still not married will she be allowed to have the baby come with her when she gets her visa?

What is tyhe rule for this situation?

Our daughter all ready has a priorty date and she is currently over 21 and unmarried. If our daughter has a baby but is still not married will she be allowed to have the baby come with her when she gets her visa?

As long as the daughter is still unmarried, the child will be able to come with her.

If she was petitioned for a family preference visa then her daughter can get a derivative visa.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!
