if my wifes original entry expires on nov 16th, 2011 (90 days)

we are already married, do we have to apply for AOS to avoid penalty for the 90 day period, or does getting married nulify that. i know we still need to apply for AOS, and we have not done that yet, we will ASAP. I am just curious, how the government will process our marriage, and not be seeking her after the 90 day visa is expired.

I entered the US the same day as your wife and I worried alot about my status so my husband called USCIS and they told him that there is nothing to worry about... there would be no penalty but it's good to get it done as soon as you can... other VJ members, correct me if I'm wrong...

If you did a search for this topic you'd see this question is asked every other day. The answer hasn't changed. There is no deadline to file for AOS as long as you married in the 90 days.

It's worth noting however that her status is not secure until she gets her GC. She can still be detained by ICE and put in detention until she goes before an immigration judge to say she can wait for the results of the AOS.
