Oh, thanks! I skimmed through his post and missed that part in the first few sentences. Eh, too bad the OP's fiancee can't go to Brazil and give birth there, right? What with the hassle of CRBA and all... :unsure:

December 2009 -- Visit to Malaysia.

February 2010 -- Applied for B2 visa, approved.

March 2010 -- Visited US.

April 2010 -- Returned from US.

May 2010 -- Sent in K1 Visa application.

July 2010 -- Received NOA2 in 71 days from NOA1.

July 2010 -- Packet 3 received.

August 2010 -- Cancellation of K1 Visa application.

If your girl has to take time off work after the baby is born, and you're not there ...

maybe you could prove severe financial hardship?

I believe the hardship needs to be in the USC's side of things unless it's humanitarian (like natural disaster or war zone).

I think an expedite will probably not be approved. Hopefully you can get your approval in time. Maybe the government will start approving faster. Good luck!

Hello Guys!

Well, I would like some tips, words of support or even anything I can do to be as early as possible in the United States.

My case is a bit complicated (someone will say, "we all have problems and go through difficult times and want to be with our love." That is quite true ... if anyone says it, I'll understand perfectly. Of course I would love that my case be speeded up so that I had with my wife as soon as possible because I feel so much the lack of her and have been almost 6 months that we are far from each other.

But is not the "simple" fact of longing that I feel for her that makes me think to accelerate our process,but she is pregnant, exactly six months pregnant or 26 weeks of gestation to be more precise. I feel that I will not have my visa approved until February (the month that will give birth to our little girl) And then? how is this situation? She needs a lot of me next to her so I can assist her in these difficult times not only in the day to be born, but now with the pregnancy, doctors and many other things. It has been hard days, and of course we keep our faith and hope for a visa to come soon, but I have not even NOA2 and according to the VJ TIMELINE I'll just have NOA2 in January. It is quite complicated! I do not know how I would feel if my daughter was born and I can not stand next to her and beside my wife. It's not simply say to yourself "Oh, patience! Life is like that!" BECAUSE IT IS NOT LIKE THAT! Of course it affects us emotionally, that's simply the loss of a special date and VERY IMPORTANT. Who has children knows how it should be special and be there when born, must be an amazing and unique moment in someone's life.

All I want is to be there with her and our daughter, I do not care about the visa process, but this is not possible so far, for so much paperwork. But still I would like to do something to be there, I will not just sit and cross my arms like a loser!

If someone, by chance, suggesting a tourist visa ... I tell you that this is not possible because I will be visa denied.

Anyway, I would like help from someone who has had a case similar to ours!

Why are you so sure your tourist visa will be denied? Of course we all understand that you want to be with your pregnant wife, but realistically, the pregnancy could have been prevented.

OP, perhaps you could go to her in Brazil when she gives birth? Just a suggestion.

We do not have much money to do that.

Because as a Brazilian citizen I can say this with certainty in the world.

Prevent? If we were talking about prevention we could prevent thousands of things around our planet. This is not the way.

I'd still try a tourist visa on the grounds that you want to assist and be part of the birth of your child. Given the proximity of birth and the timing of the K-1 petition, you might get it because it is apparent that you are not trying to shorcut the K-1 process (because if you are, you would only be gaining a few weeks at the most, not worth it I'd think and they might too). It might even be better if you present for example the plan (and possibly air tickets) that upon birth, you, child and fiancee would go to Brazil to complete the K-1 process.

Worst that can happen is a deny and you would be in the same place you are now -nothing to lose-, but there is much to gain.

We tried a tourist visa too, it did not work and now i feel silly for losing the time.

If it makes you feel any better, i am in the same situation but we haven't even filed the I129f yet, i am waiting on his signed G325a and letter of intent.

It really shows a huge cultural gap, in my opinion, that the US doesn't care about infant bonding and these sorts of things.

It has nothing to do with "cultural gap". The bottom line is that if being pregnant with the Baby of a USC or getting a USC Pregnant was an express ticket to US Immigration then there would be even more fraud.

Don't even consider how you can prove the paternity BEFORE the child is born, I'm sure there would be outrage when it's required.

The process needs to be kept simple not cluttered-up with additional complexities.

Not passing any judgement but with a little bit of planning and/or restraint the pregnancy could have been delayed until after the immigration process...
