I am a european entrepreneur looking to move to the US and I'm planning to take the extra-ordinary petition for a greencard route together with a lawyer.

I have a hard time understanding how long the process will take, and if I can travel back and forth on the visa waiver while waiting for the approval, or if I will be stuck waiting in my home country?

I already have most of the evidence together and I'm generally well prepared.

As I understand it - if you can use the VWP to enter the US, you can do so, even if your applying for a greencard.

Just answer the questions when you use it honestly - remember - you will have to prove home ties to CBP to be allowed in, regardless.

The process can range anywhere from 6 months to 2 years - really depends on the type of visa and work load.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

thanks for the reply - how long do I have to wait between each VWP entry once I have filed for the greencard?

If you plan to use WVP to stay somewhat permanently is US while waiting on visa, soon you'll be denied entry at POE. No more than 90 days at a time, no more than 180 days in a year.

Have you spoken to a Lawyer?

Are you talking about the EB5?
