N 400 eligibility based off of abuse waiver

Hi all:

I wanted to ask what is the time-line that one may be eligible to apply for the N 400 if one received removal of conditions as permanent resident based off of abuse by USC spouse? I have heard it is 3 years. Am I right? Has anything changed? Does anyone have any advice or similar experiences? Thanks in advance.

REMOVAL OF CONDITIONS

07-31-2010: I-751 off to VSC (Day 1)

08-04-2010: Date Of NOA1 (Recd 08/11/2010)(Day 4)

08-10-2010: Check Cashed (Day 10)

11-10-2010: Biometrics Appointment

27-12-2010: 10 Year Card Received

5 years if divorced from USC.

3 years if married to USC.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

Thanks, but the divorce came through after the waiver petition. There is small detail here which is why I am confused. I am not married now, divorced, but the conditions were lifted based off of abuse. Now when do I become eligible? 5 or 3? Appreciate the reply.

Timeline

You are no longer married so you wait 5 years. You cannot naturalize at 3 years based on marriage as you are no longer married.
