What to expect after I-130 is reaffirmed

hello, VJers:

Calling on experts for their advise.

What can I expect to happen with required documents at the NVC level?

Will my fees expires for a CR1? Do I need resubmit and I-1864 to the NVC? If not, should do another since its been almost a year for my husband to take with him?

When should my husband get his police/court certs, and exam? Should he wait until they call him? How does he get another appointment letter for the exam?

How long can another interview date take?

Please let me know your opinion.

After u get reaffirmed USCIS sends ur case to NVC (this is just a formality and it usually comes in and is logged and they send it right out to Casa)...You may get an email from Casa (we did not, got our appointment date by calling DOS), u will have interview, after approval they will tellu what documents (police, court, birth cert., I-864 (fianancial), and physical and updated immunizations) you need and how long u have to return them. And then they will tell u when to pick up VISA!!!

It took a while (dont remember exactly) for NVC to get our case...USCIS wasnt quick to send as they said they would....congrats on the reaffirmation.

If he is interviewed after your 2 year anniversary and approved for a visa, it would be an IR-1 visa (10 year green card would be given at the POE). I am not up with certain things. Please explain what you mean by CBP? How do we request for the IR -1 status if he is given a CR-1 visa? I am confused about that process.

CBP = Customs and Border Protection; when arriving at a US Point of Entry (POE), officer from that agency are the ones who are processing people. As for asking for IR-1 status, your husband simply tells the officer the date you two were married, that date was over two years, and that he is eligible for IR-1 status.

Your lawyer is either an idiot or a liar because the only thing he got right was that the case will pass through NVC before it goes back to the Consulate. The only way there won't be an interview is if the Consulate decides to deny the visa again WITHOUT another interview. This would be quite rare. Everybody, including lawyers, needs to understand that USCIS does not issue visas. Visas are approved issued by Consular Officers.

Facts are cheap...knowing how to use them is precious...

I agree you have no guarantee of anything at this point. If your case is not returned because the consulate strongly feels it is not legite, your spouse will be asked question about your relationship to validate the bonifides of marriage. Be Prepared.. My husbands second interview was more in depth than his first. I completely front loaded our NOIR. My husband left the consulate with 50 pounds of evidence. The questions were unexpected. Good Luck.
