I-129F SENT BK FOR REVIEW, NOW MARRIED. BEST COURSE TO FOLLOW?

There is no point in withdrawing anything since the petition has been expired just go ahead and file I130 petition, that will give you a better chance.

Thank-you Mill, I will continue as planned with the I-130 and no longer be concerned about the I-129f.

Did uscis send to you a letter that the K1 petition has expired?. If they did the better for you to file in the I130, when a K1 petition expires there is no way for uscis to continue with that case, it is considered closed, then you may then file in a new petition, but since you are now married the new petition you should file in is the I130 petition.

The K-1 has expired.

Did uscis send to you a letter that the K1 petition has expired?. If they did the better for you to file in the I130, when a K1 petition expires there is no way for uscis to continue with that case, it is considered closed, then you may then file in a new petition, but since you are now married the new petition you should file in is the I130 petition.

I am refiling with I-130. I guess my question had been since Lagos sent the I-129f back to USCIS for review, should I go ahead and file the I-130 with the I-129f still in review? In other words, do nothing about the I-129f and continue forward with the I-130 since we are now happily married?

AlexBa, we are in the same boat. my husband then fiance was also denied few months ago in Lagos and we have just recently started the CR1 process.

We are still waiting for them to send us notice that they have received the petition in the US. How long did it take for them to mail you here in US that they have received your returned petition?

my thoughts to you is to go on with the CR1 process, but let me know how long it took before you knew they had received your petiton here.

We are still waiting for them to send us notice that they have received the petition in the US. How long did it take for them to mail you here in US that they have received your returned petition?

It took just over 3 1/2 months for the I-129f to be returned to the US for review. I'm still gathering more evidence before I send in our I-130 petition.

So sorry to hear that you have to go through the same thing. It is frustrating but certainly will either break or make you as a couple. I know that I am definitely learning patience. It is very hard to be away from your spouse. My husband and I speak every day and that is what part of the problem was I think. We didn't have call records because we both used pre-paid phones and phone cards. We both saved our expired cards but those are no longer acceptable in Lagos. So we have asked both of our respective phone companies for call records. Mine should be coming shortly. I now use Localphone for my calls as I now have a local number assigned to my husband that I can call and they do keep records that can be downloaded and printed. So even if we don't get records from before we were married, we will now at least have them for after.

We are in the same situation. Our petition was sent back to the USCIS September 20, 2011 and received in November 10, 2011. We are waiting to receive a letter from the USCIS. And we are planning to get married in the Philippines too. Good luck to us in the future.

It means, you don't use any other service for talk everyday, do you? Like Skype maybe? or Yahoo? If you don't, maybe you can start to use one of them, and more way cheaper since has been said that your husband already have his own computer. If you have credit cards, you can use Skype service, this is my thread about it, . Also with Skype, you can make video calls, print screen the screenshots, for proofs.

You have to understand that both my husband and myself are computer challenged. We're doing great in his being able to respond to my emails. The other problem is where he lives. Most days there is no power so no way to charge the battery for his computer (one of those mini things). Most of the time his connection is poor and very slow. Skype is definitely one of the options we are going to try. Once I download it to my computer I can hopefully walk him through what to do on his end. (he is still learning to type and use the computer). Sort of the blind leading the blind. LOL. Good thing we both have a good sense of humor. That will be exciting as the mini he has has a video camera built in it! As he says, small small. Little by little we are getting there!

He should know when you are online unless you are in invisible mode, he he he. That's pretty hard if he bought computer AFTER you met him.
