Any time you have earned income you are supposed to file a tax return. The IRS would love to see a tax return from the time you turn 18 until the time you die. I would just get a tax transcript of the years you have, send in only the most recent year as required and keep the remaining tax information for the interview.

You could file a return with the IRS and then get a transcript if you really feel the need.

If I am trying to sponsor someone for their residency but i do not have a tax return for one of the three years can I just bring in my W-2 from that year. I dont have a return because I did not file and I did not have to because I did not earn enough for that year.

You are relating to 3 years Income Taxes but you never stated what year you did not File. So I assume 2010. Evading will never help get an answer. Also, 2011 is almost over and Currant Income must show for that at the time of the interview in 2012 would'nt you think.? If you did'nt have to File a Tax reyurn it means you made less than $4000,00 in wages for that year. Just my thought. I'm sorry.

You write a letter explaining why you weren't required to file. No problem.

If your filing status was single, you don't have to file if you made less than $9,350 not $4,000. http://www.irs.gov/publications/p501/ar01.html#en_US_2010_publink1000220675

To the OP> Get transcripts for the years you did file, and write a statement that explains the legal reasons you did not have to file the year you missed. You can include a copy of your W-2 if it helps show you legally did not earn enough to have to file.

Well, seems there are Currant H & R Tax Preparers with degrees in Immigration as well. Oh Please. Tell the OP the truth...

What are you talking about? He linked the IRS page which explains that it's $9,350 for singles. Did you even look at the link?

The IRS Pubs are not the truth? Does the IRS know this? Perhaps you should contact the IRS and set them straight on their tax laws. Let them know you know the "real truth" and their Publications are false.

Wow...
