Hi, i am new to this forum and I dont know if posted on the correct thread. In 2002 i had my b1/b2 renewed and got another 10year multiple entry. The problem is during the renewal (thru dropbox that time) I did not declare that I was already married for about less than a year, the reason was I was having hard time obtaining my marriage certificate and the renewal was a family renewal with my parents, they dont want to delay as they will be leaving soon at that time so I stated I was single. Now, I scheduled for an immigrant visa interview at the US embassy in manila as a derivative applicant of my husband, I just want to ask if the consul found out about the misreprentation, will this cause denial of my visa? is this "material misrepresntation"?

I hope someone could give me opinions on this. Thanks you in advance

did you marry before you sent the renewal in or after?

if you didnt declare your marriage at the time you sent in the forms then it very well could be an issue... there are others that will certainly be able to give you specifics.

I renewed after I was married, just to add up, my husband is a Filipino and doesnt hold any kind of US visa. We are both present at our home country at the time of the renewal. My husbang hasnt been issued any kind of US visa to date.

but you listed single when in fact you were married his domicile wouldnt matter... single is single... married is married... that could be a problem... but hopefully somebody else can come along and give you more information

Yes it's a lie (misrepresentation). Will it make you inadmissable? Probably not. I don't think it's a MATERIAL misrep, in that by lying you gained a benefit you would otherwise be ineligible for... but it is a bad thing to lie... Only time will tell how bad this will be for you.

I know and its been haunting me, I have been googling similar situation but i havent found any, mostly they lie on an immigrant visa or a non immigrant visa where in the put "married" but they are single, Yes you are right, its a lie and I can just hope for the best.... Would you know how particular are they with past visa? my immigrant visa interview is fast approaching and its already giving me nightmares, my husband was petitioned under eb3 category. Thanks a lot to those who have given their inputs, I am really hoping for the best on this.

In order to be considered a material misrepresentation the consular officer has to conclude that the truth might have changed the decision. Being married can be considered by the consular officer when evaluating a DS-160 for a non-immigrant visa. For example, having a spouse who will remain in the foreign country can improve your claim of strong ties. It could be a material misrepresentation to claim you had such a spouse when you actually didn't. On the other hand, having a spouse who is a US citizen living in the United States can increase their suspicions of immigrant intent. It could be a material misrepresentation to claim you didn't have such a spouse when you actually did.

I don't think there's a material misrepresentation here. It probably won't be an issue.
