Hey guys, we got married last month and are about to send off AOS documents. We got married in City hall and I (USC) ended up changing my last name automatically on my marriage license. However, I have not yet made any other last name changes - SS & school documents are still all in my maiden name. I am about to graduate grad school and in the process of looking for jobs, and I realized the difficulties of going through the process now to change all my documents to my married name. I would really love to HAVE MY MAIDEN NAME BACK. I called 311 to ask how this can be done and the process is a simple amend to marriage certificate that would change my name back to my maiden name on the certificate. HOwever, it takes 6-8 weeks to process and we do not have 6-8 weeks as my husbands i-94 is about to EXPIRE next week and we want to file asap for aos.

So my question is: can I file AOS in my MAIDEN name and send a note or make a document ill get from the city clerks office that I am changing the surname on my marriage certificate (I will be sending the one with my new name). Or should I file in my NEW SURNAME and then do the amend a week after we file since itll take time anyway? I am thinking that they will be more concentrated on HIS application than my name but I am still worried.

You do not HAVE to file for AOS before his I-94 expires. You can file after the marriage cert is amended. However, if you are really wanting to, you can just file and enter your maiden name and put in a note that you are having the marriage cert amended so you can keep your maiden after all. The application process is for your husband, so I do not think it will cause any troubles either way.

You do not have to file before the I-94 expires. There is no particular deadline

Your husband is changing status, right? Not you? Then your name really makes no difference. You can change your name any time you like and it has no affect on the AOS, HE gets the green card, not you. If you feel it is necessary, then just attach a letter explaining that you are in the process of changing your name back.

You could do either one you suggest except you do not have to amend anything if you change your name after filing, USCIS has no interest in a US citizens name. Just keep documents attesting to the change to be filed with your Removal of Conditions later.
