My husband and I are living in South Korea as an expat .It's like I am in the CR1 processes (package3) and we want to go visit my husband's family during x'mas.Is it okay to apply for tourist visa during your CR1 is pending?

You can apply. You will have to show strong ties to Thailand. More than likely you'll get shot down. I'd just wait for the CR-1.

You wont be issued a tourist visa; expecially with a pending petition. You certianly can apply. Getting an interview date will prove difficult. The interview will be easy because it will be denied.

Yes you can apply, and since you are living in South Korea, you would need to show strong ties to South Korea (even though you are a Thai national); however, the odds of you being granted a tourist visa with the immigrant visa petition pending are very low.

September 2007: Met online via social networking site (MySpace); began exchanging messages.
March 26, 2009: We become a couple!
September 10, 2009: Arrived for first meeting in-person!
June 17, 2010: Arrived for second in-person meeting and start of travel together to other areas of China!
June 21, 2010: Engaged!!!
September 1, 2010: Switched course from K1 to CR-1
December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!
February 18, 2011: Wedding ceremony in Shiyan!!!
April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

hmm yeah, actually our CR1 process is kind of pending now because of my husband's jobs in Asia. It's like we will go to USA together and come back together.. So is it strong enought? what you mean by the strong ties? could you please give me some example?

BKK is famous for being tough on tourist visas. However it looks like you will apply in Korea. Doesnt matter as the outcome would be the same.

Strong ties means you have to prove beyond doubt you will return to Korea. As a Thai citizen I dont see how you will be able to do that.

What reasons would you give to show you had to return? Keep in mind all people with any type of visa are considered intending immigrants.

Even if you somehow got a tourist visa you would probably be turned away at the POE. The moment you enter the USA your ties are to your husband.

05/2007 Antje had to go back to Germany

10/2009 got engaged in TN

12/31/2009 got married

1/7/2010 I-130 sent

1/9/2010 I-130 delivered

1/13/2010 check cashed

1/15/2010 NOA 1

I think a returning husband to korea should be the strongest tie you could have. so maybe there is a slight chance going from there.how much longer will your husband stay in korea that you dont want them to issue the cr 1?

The same husband that petitioned for her to immigrate to the USA.

Well,i do not need a visa to go to the usa but we had the same situation.we both are living in germany and started the visa.now,my husband and i decided to stay here longer for job reasons.we took his and my contracts and they understood.i was so nervous but we had no problems.dont know if there is anything they can lose by trying.i just didnt need it.

08/2006 met in GA, U.S.
