My fiancee..now wife and married on K1 Visa from the Philippines, we also brought her 2 year old daughter on K2 Visa they both recently applied for AOS and awaiting response from USCIS.

The question is how can I change the last name of my step daughter to follow my last name since I am NOT the birth father and the child does not follow the last name of the mother also.

For example:

Mary E. Lee (mother)K1 Visa.

David Lee (husband) and petitioner.

Lisa Villano (stepchild) K2 Visa.

Its quite a difficult situation since the child has a differant last name from both the mother and myself.

Im thinking ahead in case of schooling and hospitalation and legal documents needed for ID.

Any help or info is greatly appreciated..Im lost as to which way to go with this.

You don't have to adopt her just to have her last name changed. Adoption would accomplish that. But you can also have her name changed by filling out the proer forms and having them notorized and filed with the statistics office. I had same situation with my ex filipina wife and her son that was also 2 when we married. We never got around to doing it though. Also don't worry about any problems with the child having different last name as far as school and IDs and all that. Aside from it being a little awkward sometimes and her asking about it when she's older, it won't get in the way of anything, her having different last name. My step son started and went all through school and everything and it was never an issue. We just wanted to have it changed simply so we would all have same last name and would be more conveinient.

You can get the exact information on forms you need and how to proceed online. Its common enough here in the states and not just for K-1 or other types of international marriages. Sorry I don't have links.

thanks for the info, I was thinking just some forms to do that. But have not got to that stage yet. School should not be a problem but I wondered about insurance and things. Only thing I dont know is if we did that when we marry will it be an issue later with AOS

Legal name changes are a state by state issue. Read up on how to do it in your state. Try google, it is amazing.
