Wrong Date!!! What happens next?

Hello,

I recently sent my N-400 application to the field office in TX. I just realized that I sent my package 10 days earlier than the 90 days of my three years residency. Based on the three years residency requirement, I am suppose to apply anytime after November the 17th. I'v been a resident since 02/17/2009. Is it common that USCIS process applications that are filled earlier than the required time? Any help will be greatly appreciated.

They will most likely return the package to you without processing it.

Actually, the earliest you would have to file would have been 11/19/2011. When did you mail it? Most likely if it it's received too early it will be returned to you with the check uncashed.

Jan 1999- F1 to USA

June 2006- AOS thru D.O.R.A.

Dec 2009- Oath. Finally a U.S Citizen

Thanks guys for your inputs. I mailed the package on the 10th of this month. I went back today to the post office where I sent my package. They checked on the package and gave me a phone number to call on Monday. I am going to request if they can put a hold on the package and deliver it back to my address.

Otherwise, I will just wait for USCIS to ship it back. Today I felt like Paul Rudd from the movie "Overnight Delivery" :)

I simply will advice you to let nature take its course. Do not try to make calls and change things. It could delay or misplace your package. Allow them to mail it back and then just send it again.

06/28/11 .. Mailed N-400 package via Priority mail with delivery confirmation

06/30/11 .. Package Delivered to Dallas Lockbox

07/06/11 .. Received e-mail notification of application acceptance

07/06/11 .. Check cashed

07/08/11 .. Received NOA letter

07/29/11 .. Received text/e-mail for biometrics notice

08/03/11 .. Received Biometrics letter - scheduled for 8/24/11

08/04/11 .. Walk-in finger prints done.

08/08/11 .. Received text/e-mail: Placed in line for interview scheduling

09/12/11 .. Received Yellow letter dated 9/7/11

09/13/11 .. Received text/e-mail: Interview scheduled

09/16/11 .. Received interview letter

10/19/11 .. Interview - PASSED

10/20/11 .. Received text/email: Oath scheduled

10/22/11 .. Received OATH letter

11/09/11 .. Oath ceremony

I agree with v333k, do not try to intercept the package as it may be on hold and P.O may forget to send it on..

But if you sent it in the 10th and Nov 11 was a holiday, it may not be delivered until the 14-15th and maybe by the time USCIS processes it may be the 19th.. Just being an optimist here..:)

Actually, the earliest you would have to file would have been 11/19/2011. When did you mail it? Most likely if it it's received too early it will be returned to you with the check uncashed.

Hi Guys, newbie here!

Something of a similar situation. I used the earliest filing calculator to find 11/12/11 is the earliest filing date.

I signed and dated the N-400 application 11/10/11

The check is dated 11/09/11

I FedEx'd the package on 11/10/11

It was received on 11/14/11

Is this a case of rejection/denial or am I fine? I still haven't heard anything from them yet. Phoenix is my lockbox facility.

Any feedback will be greatly appreciated.

impatience....

have it out ASAP and be done forever...

and who knows, maybe save some $$$ in case of fees increase

In addition to Maad's comments, which I agree as well, excitement! Just wanna get it out of the way and have it done with! As a result of which, I didn't realize there was actually a calculator. I just subtracted 90 days to come to 11/10 and applied. Didn't realize they were so particular.

BTW, I did talk to my attorney and he did mention it is the date they receive that matters.

You guys should be made aware of the DISADVANTAGES of filing exactly 90 days before, if your application gets processed too quickly (and this can happen depending on what field office you have) you will end up having your N400 interview before your 3 or 5 year anniversary date. This means they won't issue you with an oath date there and then, and your application may go on a BIG pile of defer cases...

many VJers have experienced long waits after the N400 interview for oaths because of this (myself also) so it makes more sense to actually WAIT 2-3 weeks after this date and then file.

Too late for me too. I mailed it 88 days into. Same to my AOS.
