DCF for children

Hello! I was just wondering if anyone else here has petitioned their children through DCF? I filed my son's petition last month. I'm a US citizen and gave birth to him last year. does anyone know if i can file form i-864w instead of i-864?

Where you a citizen when you gave birth? Unless you have never actually lived in the US, your son should be a US citizen. You should be filing a Consular Report of Birth Abroad and he can get a US passport.

If you son is not a US citizen, he will become one upon entry so it appears the I-864w is the appropriate form.

Intending immigrant is a child who will become a U.S.

citizen immediately upon entry under the Child

Citizenship Act of 2000 (CCA). Under the CCA, some

children become U.S. citizens immediately upon admission

to the United States or adjustment of status to that of a

lawful permanent resident. For this classification to apply:

At least one parent of the child is a U.S. citizen;

The child is under 18 years of age at the time of

admission or adjustment of status;

If the child is an alien orphan child adopted abroad, the

adoption was legally finalized prior to admission to the

United States and both adoptive parents or the unmarried

U.S. citizen parent personally observed the alien orphan

before or during the adoption proceeding.
