affidavit of support, gross or net?

I'm trying to make sure I'm above poverty level but I'm not sure about 2 things. Do they base it on gross or net pay? I also have other deductions on my paystubs for pre tax medical insurance, 401k and child support. Are those deductions also considered when trying to make the 125% poverty line for 2 of $18,387? I hope smbody understands what I'm trying to ask and can help me...thanks for any help.

1. The Department of Health and Human Services on

February 7, 2003, published its annual update of the

Poverty Guidelines, taking into account increases in

prices as measured by the Consumer Price Index. Posts

should begin using these new guidelines in calculating

levels of income and assets that immigrant visa

petitioners and joint sponsors must demonstrate in their

I-864 Affidavits of Support.

2. The following are the 2003 Poverty Guidelines for the

48 Contiguous States and the District of Columbia:

Add $3,610 for each additional family member.

5. When processing immigrant visa cases subject to the

affidavit of support (I-864) requirement under INA

212(a)(4)©, posts should use the figures in the column

on the right, 125% of poverty guidelines, as the minimum

income that a petitioner and/or a joint sponsor must

demonstrate. Visa officers are also reminded to consider

the "totality of circumstances" (including the applicant''s

age, health, and education) and can deny visa issuance

under 212(a)(4)© if the applicant appears likely to

become a public charge despite satisfying the poverty

requirements.

Thanks guys...idk why I was thinking net. I gross 29k but after taxes and deductions it brings my net down. My son doesn't live with me but we take turns every other year claiming him on our taxes. Do I still need to put him as a dependent because last year I claimed him? Or partial dependent on I-134 form? Thanks again for any answers.

Yes, children under 21 are counted no matter where they live. This is from the I-864 (not I-134) instructions but Consular officers tend to use the I-864 standards for their judgment calls, since you'll soon be needing to meet that standard when the then spouse adjusts status.

How about for self employed??? I have been told it is the net. It will be just for the 2 of us on a K1 so I am hoping you are correct on this, but i have been told many times for me it is after business deductions. Thanks

It's line 22 but you should include sched C with your 1040

Dont use the 2003 table, it gets revised almost yearly there is one current for 2011. Requirements are based on people IN your household living with you but if you re claiming someone on your taxes you will probably have to count them as part of household but i would research that.

Neither "gross" nor "net" are appropriate terms here. The IRS uses the term "total income". This is the amount you have to live on before taking into account personal deductions, exemptions, credits, and taxes. For someone who is self-employed this is the amount you have left after your schedule C business deductions. In other words, it's the taxable income your business pays to you. Line 22 on the 1040.

Anyone you claim as a dependent on your tax return is also a dependent for an affidavit of support. However, your child is always a dependent for an affidavit of support, regardless of who takes the tax deduction for them.
