Hey Everyone,

I am getting ready to file for EAD renewal since my AOS is still pending (sad!!)

Anyway, I've done my homework so far and I believe I have everything wanted to make sure with you experts(hehe):

1. Copy of old EAD (front and back)

2. Copy of NOA

3. I-765 application (renewal)

4. 2 passport style photos

My biggest concern is that I have to pay, but the instructions both on the USCIS website and on the i-765 instructions state that you do NOT have to pay if you have an AOS pending.

Is that true?

Correct - if you have an AOS pending - you do not need to pay for the EAD.

You will need to provide proof of the AOS - the NOA will do nicely.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

It's STILL pending? I suggest you contact you congresssman/senator to find out what's going on. Processing for a year is very odd.
