I'm one of those "talking heads" and I'll thumbs up Boiler's answer as some of the best advice you've been given here. Every case is different. If you have concerns, speak to a qualified family based immigration attorney. Go over with him/her IN DETAIL about this entry to the country - ie the questions you were asked, how you responded, etc. Then proceed.

Depends. If the I.O. denies the petition based on presumed misrepresentation, which is totally at his or her discretion, the denial can also carry a lifetime bar from the U.S. In some cases it has also been lead to an immediate deportation. Since there is no appeal for a VWP participant, that would be a final decision, written in stone.

OP if what Brother H is saying is true, and there is no reason for you to overstay, you should go home. Do you want to take a chance with your future in America?

If you were already overstayed I would be saying just stay here, that was our situation and since we met after she was already overstayed.

I did adjust my status from Tourist visa (and i did not have to go back home) to resident and recently i became a citizen. What matters is that the marriage is real and one did not have an intent to migrate here.
