thanks guys .. were still talking but about the tickets i think hes done on it and doesnt want to talk .. all i can do now is to get help from home .. and he also got some cases that going to jail or something,he didnt told at all so we think our relationship will not work out.help me God. bless you all.

Hi,

That is really sucks lol..well u gotta figure out how to go back home before 90days run out..call family,friends or whoever that are willing to help you,but your ex fiance is the one who is responsible for your ticket.why and what is the reason he don't want to buy u a ticket???sounds not right to me...that is a problem when you travel without any dime in yur pocket.hope all is well.

USCIS or the US government WILL NOT pay for her return home. That's on her and her ex-fiance.

This is correct, but notice that the I-134 that all of us sponsoring a K-1 signed, obligates (enforcing it is a different matter maybe), but since we represented that we the USC guarantees (see 5 in I-134)that the person being sponsor will depart before expiration of his/her authorized stay, I can only understand "guarantees" in this case as providing return ticket.

I'd suggest to call USCIS, notify that marriage will not be happening, OP wants to return to country of origin, no funding available and that according to I-134, compel USCIS to enforce the I-134 agreement the USC has signed. I don't know if anyone here has done it or know of someone who has though.

It seems clear to me that the USC is obligated and not just morally to provide a return ticket. I-134 is not as enforceable as 864 perhaps, but let USCIS sort that.

Failing all that, I'd contact the nearest consulate of your country for aid in returning.

I asked the pro I use for all my work, he is one of the best. If you have no family to help you and you truly are stranded here is his advice............ If the petitioner has decided not to

marry her and it is very clear that he will not pay her way

back home, then the Affidavit of Support, I-134, can be used as leverage to

generate some cooperation from the petitioner.

Your Consulate won't help. USCIS won't help her, unless she eventually

gets a deportation order and turns herself in. She would then have the

option of sitting in a detention center or contracted hotel until USCIS can

arrange transport. I wouldn't recommend the latter path.

My advice is to suggest two options to her:

1. Contact a representative from the local Fil-Am or Filipino Association

and ask for assistance to return to the Philippines; or

2. Obtain the services of a third party to act as intermediary to remind

the petitioner of his potential liability form the I-134, Affidavit of

Support, unless he contributes to his gal's comfortable departure from the

U.S.

Grab a yellow page book, the telephone directory, find them.

How long have you been in the US? Unless he's a murderer, why not give it a time for both of your head to cool off then talk again. I am sure he's frustrated too that you can't stand by his side knowing he can be incarcerated. We don't know yet for sure, who knows he'll be exonerated?

Call San Fo office as well as a back up but give it a shot at least before you leave. Just sayin.

OP's issue seems to be that her partner didn't TELL her he had cases pending that could result in jail time. If he hid that, who knows what else he could be hiding? She didn't come here to ask for relationship advice and has already stated they talked and nothing is going to work out. I don't understand why, everytime there is a thread like this, someone ignores the question being asked and instead advises the OP to stay in a failing relationship.

To the OP, your ex is not obligated to provide your plane ticket home, though it would be the decent thing to do. Contact charity organizations, local churches, and the embassy from your country to see if you can get help getting home. Unfortunately, working is not an option and there is no way for you to stay here and become legal short of marrying the person who brought you here and filing for AOS.
