Sick with worry

I have my interview scheduled for Dec 9 in Montreal. I have two things I'm stressing out about.

1) His income taxes don't accurately reflect his income. He's military and his housing allowance (1500/month) and last year's deployment pay (4 months salary) was not on his income tax because it's non-taxable income! We're getting a letter from his CO saying how much he really makes, but honestly his tax forms look a bit sad and I'm not sure we're above the poverty line based on taxes. I'm bringing in some of his pay stubs as proof of how much he *really* makes, but will that be enough? What we said he's going to make this year on the i-864 and what it shows he made last year based on taxes are VERY different.

2) He deployed recently (will be home in March, when I intend to move) and gave up his apartment. We're using his FPO as his mailing address and using his military Home Of Record (HOR) as his residence. I need to change his address with USICS but is this going to flag us too much? We'll never actually live at his HOR since it's across the country from his duty station. If they ask me at the interview where we will be living, I'll just have to explain that we're just going to find an apartment when I move out and he gets back and his HOR is just for paperwork purposes? He doens't have a physical address at his deployment site, but I'm sure we could figure it out. That seems like a terrible idea as well since I obviously can't go there.

I'm sick at the thought that we'll get denied over these things, but it's really hard to document most of this. Am I over thinking this? What else can be done?

You wont because they know these things. Nothing happened with ours and many other military spouses who went through Montreal as a K-1. Just explain the issue to them, you are way way over thinking this. You are way more upset and freaking out than you need to be.

This is better posted in the Canada section though since it is Montreal specific.

The income on the tax forms indicates income AFTER deductions, so they know its not how much he "really" makes. If you can bring pay stubs to prove income, that should be fine.

1. Not a problem. They go by total income not taxable income. Just be sure you document everything well. They also go more by current income than by last year. They also. for instance, count "child support" which is not claimed on income taxes either as long as it is documented.

2. Not a problem, he is military and they often have this situation.

Good luck

The income on the tax forms indicates income AFTER deductions, so they know its not how much he "really" makes. If you can bring pay stubs to prove income, that should be fine.

This is not true. They go by total income, line 22 of the 1040 which is before any deductions PLUS any non taxable income not reported on the 1040 which can be documented.

Sleep well you are fine!

Thank you everyone, I feel a bit better. I'm just so worried.

Just to piggy back - where can I change his address, I'm trying to do that now, but I can't seem to figure it out. I'm frazzeld. Since we're at the interview stage do I still have him file an AR-11? My petition is no longer pending, but the visa is. Who we change the address with? Sigh.

Change his address at the interview if you need to.

When you get to the USA just put the new address your at on the AOS forms.

If you move again after that then you use the forms for the USC and the green card holder on the USCIS website.

Really? We don't need to do anything now? I'm okay with that.
