Adjustment of Status??

Hello, my name is Jason I am a British Citizen that I guess you could say is half way through the K-1 visa process that is, I am in America and married to my lovely wife so you could say I'm over the K-1 process but with the whole change of status deal it doesn't feel like it! Anyway I have the majority of thing taken care of and before I file the remainder of the paperwork, I have a few queries that I want to put forth just to make sure I get this done in one.

I have gathered and filled in these forms With the following evidence:

$985 filing fee + $85 biometric fee for money order of a total $1070

Cover Page

I-485 AOS:

Copy of Birth Certificate

Copy of K-1 visa

Two colour photographs (2"X 2")

Petition approval notice

Copy of marriage license

1-94 Depart/Arrival record (front & back)

I-765 EAD:

Identification i.e.: Copy of K-1 visa

Two colour photographs (2"X 2")

1-94 Depart/Arrival record (front & back)

I-864 Affidavit:

IRS docs

I-693 Medical:

cleared of TB

Flu Shot given

vaccination records already transcribed and sealed

G-325A Bio

G-1145 E-Note

File the above, wait for notice, then attend and AOS meeting/interview to have passport stamped in a view months. Oh, and I know about the 131 AP form I'm just not sure I want/need it to be honest.

Now for my questions!

Q.1) Am I missing anything? (Which is sort of the only question)

Q.2) The filing fee for the I-765 is that waived because I am filing an I-485? In other words in $1070 all the money I am sending?

Q.3) Am I sending the packet to the same address or do certain forms go to a different locations?

Q.4) Is there anything specail that needs to be done for the IRS docs? Or is a straight online print off acceptable?

Q.5) Is everything here acceptable? Basically my one and only question: What's wrong with this picture?

1. Yes.

- The EAD does NOT require the I-94. It requires a copy of the passport biographical page. You can include the copy of the I-94 but you need to add the bio page.

- With the I-864 apparently now you require a letter from employer to verify that you are still employed. (can't use the one from K1 'cause it's too long ago, need a recent one).

2. Yes. Make sure you write the check out correctly.

3. Chicago lockbox. All to the same place. Then they'll be split when it arrives.

4. What do you mean "straight online print off"? You need either the IRS tax transcript (obtained from the IRS) or tax return plus all attachments.

5. I would submit the AP. it's free. It's a very simply form and the attachments are stuff you already have copies of so making another copy isn't an issue. While you might not "want/need" it right now. It's quite often that people wish they had applied for the extra document that cost nothing extra because it takes too long to get an emergency one otherwise.

You file the documents. You'll get a text with the NOA1's (thanks to the G-1145), then the physical NOA1's. You'll get a biometrics notice (probably two for the same day/time) as you need biometrics for AOS and EAD (not for AP). Then you wait. Your case may be transferred to CSC (quite common) and you might NOT have an interview.

The instructions clearly state where to send the file http://www.uscis.gov/files/form/i-485instr.pdf

The only payment is $1070 USD for the whole thing.

Copy of the non US Citizen Spouses Passport (biographical page as well as entry stamps).

Make sure you have all items needed by crossing off the items from the list on the step by step AOS guide.

These are not required for AOS. They are not listed in the AOS instructions. The bio page is required for EAD though. Just FYI.

Thanks everyone you've put my mind at ease! As far as my photos go, will I need to sign/date them??? I haven't had time to go through the AOS instructions I was given here in there entirety but I will tonight!

For the passport photos, write your full name and your A# at the back (preferably in pencil).

I used my K-1 employer letter with the old date but included more recent pay summaries...no problems.
