i have been in italy legally with a work visa since april. i live with my wife i have a work contract. i have a codice fiscale and a iam sill waiting for my premisso di sorggino (a work permit which is already approved thats why i can work) is this enough to claim residency? italy is so slow when it comes to issuing identity cards but i have defenitly have alot proof that im allowed to here and i have extablished my self with these documents do you think they will take as being a resident so i can file for DCF?

I checked into this at one time via the Rome consulate and was told a minimum of 6 months was required, but we decided to file back in the States instead. Yes, Italy can be slow, and all the little forms and stamps and offices we had to visit to be married in Italy was enough to make us file the CR-1 in the States (7 months beginning to end).

The minimum time I noted above may or may not have changed since I initially inquired. Things are always changing and sometimes people here on the forum may have info (like me) from awhile ago. I would strongly recommend contacting the closest consulate either through a phone call, email or a visit. Note that as a US citizen you can usually foregoe the wait that non-US citizens have and usually get in for an appointment quickly. They will tell you straight up what you require.

Also Rome has a USCIS office that you can contact, and I think this is the office you have to file the I-130:

THANK for the info and i know what you mean about getting married in italy im at the end process and boy it was a journey ive been to every type of civil office in italy to get the paper work i need and also the counsulate in florenece and had to go through a one month course with a catholic preist! pretty intens but all worth it as long as they accept me as an esablished resident so i can send my i-130 in december. i called and they said since i have a a work visa dated 6 moths abck and i have been in the country working consitently i should qualify bu to be sure i should get in writing. so now iam jsut waiting for a reply!
