Considering 2012 is almost here and NVC could take a month to generate a case number, if not more, I am wondering if my paperwork gets in during the month of Jan what do I write for Q. 25 on the I-864 form? 2011, 2010, 2009 or 2010, 2009, 2008?

Until April 2012, you'd only need tax returns for 2008, 2009 and 2010.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

And if you file an extension in 2012 for 2011....you won't need 2011 till Oct. 2012!!! So you should be good even through your interview.

btw, I have a cousin who is going through this same process (still waiting for her NOA2, but it should be any day now) and she has been out of work so far this year though this week secured a position starting in Jan as well as now has a co-sponsor... So my question is, by her not working this year and provided her NVC Case # is available, can she immediately come January send the I-864 but instead representing 2009--2011, considering there will be nothing to file for 2011?

Not so much, Bob. I've seen them ask for a return from the last calendar year as early as late February. Even if you file an extension, they can ask for a copy of the extension papers. This becomes a bigger issue for the self employed or the employed who don't have long term steady employment, not for everybody.

I haven't filed yet doesn't overcome, then your beneficiary doesn't get a visa yet. whistling.gif

And even if one gets through NVC step without 2011 tax documents, the Embassy/ Consulate will definitely ask for 2011 tax documents.

We were asked for a copy of 2010 W-2 at interview eventhough we submitted IRS Tax Transcripts for 2010, 2009 & 2008. So a lot depends on the Enbassy/ Consulate and we have to satisfy them to get visa.

USA

01/08/13 - Approved and GC is order for production on 1/8/14

09/12/13 - Case transferred to CSC. NOA2 received on 09/18/13

08/30/13 - Biometrics Done - No walk ins allowed at this LSC (received on 8/16/13).

08/05/13 - NOA1 (received on 08/10/13)

08/01/13 - Mailed I-751 (received on 8/2/13 - check cashed on 8/5/13)

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)
11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.
