Applying for a job before EAD is approved

Hello, everybody!

I have a couple of questions, concerning finding a job in the USA.

I have no intentions of starting working before I have my EAD in hand, but I was wondering whether I can start filling out applications now, stating that I will be able to start working no sooner than in 2-3 months. I was just thinking that maybe I'll get lucky and I will be able to save some time and start working as soon as I get the EAD (cause I'm pretty bored by staying at home).

But if I try to apply somewhere, how do I reply the question "Do you have legal permission to work in the States?" since I don't have it right now, but I will have it in future?

Also... I have a 5-year degree from a university in Russia, which is a so-called "specialist degree", so it's neither bachelor's nor master's (most of the times it's considered as master's, but I don't have my degree evaluated yet, so I'm not sure).

I'm not looking for anything big and important, I would be totally happy with a small part-time job or an internship (I'm a recent university graduate and I do lack experience).

There's no legal rule about this, so each employer determines their own preferences. In your place I would definitely start applying now and saying "yes" to the question. Remember, at this stage your goal is to get the interview - and during the interview you can iron out all the specifics of your situation. Good luck!

You're welcome. Be persistent. Many employers are flexible and many aren't - you won't know till you actually apply. I managed to get an internship and a job before the authorization, but I was very open about the situation during the interviews and the employers were willing to wait till the paperwork comes through. So show them some good faith and you'll be fine :thumbs:

I would apply for a job before your EAD is approved. That's what i did anyways. I would apply two months before your expected aproval because the hiring process takes about two months on average so if you get hired your potential employer can wait a week or so.

What I did, I applied 2 motnhs before I got my EAD. On the interview I would tell them that I'm in the process of getting my EAD and I would ask them when they expect you to start. Based on that you can talk to your employer and see if you can work something out. If they really like you, they can wait for a week or two.

Just be upfront and honest during your interviews...

If your application is to an employer who uses the E-Verify system, be prepared to be rejected if you haven't yet obtained your EAD.

I applied for a few (local government) jobs before I got my EAD and never even heard back. However, the minute I had my EAD everything changed and my applications were immediately much more successful.

And it wasn't anything to do with improvements to my applications - they were basically identical.

This is interesting for me as I am at this stage now. I want to work for local government. I just wanted to ask (if you can remember this far back lol), did you tick 'yes' to the question about whether you were eligible for work? I don't want to lie on an application form but the general opinion from the threads I have read is that it's ok to say this on the form and then iron it all out at interview, if I get that far.

Don't ever lie; delays happen, and an employer can reject your application outright if it's discovered that you were untruthful.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
