Trying to Apply for a B2 Visa for Mom (I am a LPR)

Hi VJers,

I have recieved a lot of help during my immigration to the USA. I went through the K1 process, got married, settled here and have got my 10 year grean card this year. THANK YOU!

I would like to invite my mom to visit us for 2 months. My mom is a govt employee (Teacher)and can come to visit us during her summer holidays. She is 58 years old and has a year and half before she is retired.

My situation :

I have tried a Visa for my mom 3 times in the past

1. When I tried for a B2 visa in 2008 and we both were denied for not proving enough ties.

2. Once I got here and had the 2 year green card, I asked for her to apply again in Oct 2010 and she was denied for the same reason

3. March 2011, again deneied for the same reason.

Our situation has slightly changed, I have my 10 year green card and have switched jobs (I was working for a UK based firm earlier and now I work for a US company and can prove with my paystubs that I can support my mom during her visit)

List of documents I have ready... Do I need anything else ?

1. Letter to the Consulate explaing why she will return to her country - ties to the church and school

2. Invitation Letter

3. Affidavit of Support I-134 Form - from US citizen - My husband (Can i support her with LPR status?)

4. Daughter's I-94 copy

5. Copy of Income Tax Return 2010

6. Copy of daughter's passport and Visa

7. Copy of daughter's Green Card

8. Copy of Driver License/State ID: Son-In-Law and Daughter

9. Daughter's Birth Certificate.

10. Copy of Son-In-Law’s Passport

11. Copy of Son-In-Law’s Birth Certificate

12. Copy of daughter's Marriage Certificate

13. Copy of daughter’s employment offer letter

14. Copy of Son in law's employment Contract

15. Bank Account statements (3 Months)

16. Most recent Paystubs for 3 months.

17. Bank Account verification letter

18. Evidence of Bank Savings (Mom's in india)

19. Copy of Mom's Voters ID

20. Family Photos in India saying she lives with my brother and sister inlaw

21. Leave of absence letter signed by the school director (mom's)

22. Property deeds and registration papers (showing mom's ties in India)

Apart from my employment letter and my 10 year greencard nothing else has changed, she owns 3 properties in India and 1 office space, we also have 1 office space that we rent that was my dad's office and now ran by my Dad's employees.

She has 4 bank accounts and has a lot of insurrance and Fixed deposits and other certificates.

All her family is in India and she is very close to them (all the above is mentioned in the letter to the consulate - they never read it)

What else do I need to prove? My mom has given up but, I have requested we try one last time. We are going to chennai with her this time and hopefully, the consulate will let my US citizen husband inside with my mom for the interview. my mom is not very fluent in english but knowns enough to communicate with my husband who is a american born citizen.

Any insite or tips would be helpful, has anyone succedded in getting your parents here, do I need to prove anything else, what are my chances?

sorry to say that they don't care about you. your mother has to qualify on her own merits. if nothing has changed on her part, she could be denied again. she still has to show strong ties to her country. now that you are getting closer to be a USC and file a petition on her behalf.

Thank you for your response.

She has ties to India (property, job, bank accounts, ceritficates) I am not sure how else can we prove her ties.. She is definately going back (not very found of cold places) and she has a grandson whom she loves and adores. Forgot to mention my mom is a widow - is it hard for widows to get B2 Visas?

Mom has to prove her strong ties to home.

Your documents do not help your mother obtain a visa. Your husband won't get some magical reception as a USC.

Not sure why you are put together that long list being 3 times denied for lack of ties - they most likely will be completely irrelevant or increase likehood of your mom getting denied again (since you are more settled than before, therefore you can easily sustain here should she choose to stay illegaly). She'd probably be much more likely approved if she was going just for sighsteeing than visiting family...

I hope I have my myself clear that my mom does have ties.. can you suggest something that I can prove apart from what i am already bringing along?

I know my husband will not get special reception at USC, but I am just hoping it will help my mom through the rough time.. I dont think some of you understand how hard it is for a old person to travel to chennai on her own and then get rejected and has no shoulder to lean on.

No one is putting you down. We are making the point that it is not about what you or your husband can provide. It is your mom (or any applicant) showing that they do not have immigrant intent.

One should try to thing like a Consular officer. The stronger the "family bond" to the US, the more ties to home an applicant should present. Presenting all the evidence that she can be supported well in the US (by you and your spouse) can be counter productive. Focus on stressing ties to home and not the strong network inside the US.

Leave Part II completely out. You, the daughter, being in the U.S. as a resident, close to becoming a U.S. citizen (at which time she could file for AoS) is only doing one thing: hurting your mom's chances to get a B2!

Bluntly speaking: for the purpose of your mom's visa petition you need to disappear from the radar!

TOTALLY agree with Brother Hesekiel... Leave Part TWO out COMPLETELY.

She has to qualify on her own, so Part One is good. Also, does she have a car loan? That is another proof that she can show.

And OP, I don't think the posters on this thread mean to be rude... At least I am not :) I just don't want to see your mom being denied again. The most important thing when it comes to applying for a B2 visa is proving VERY STRONG TIES TO HOMELAND (i.e. India in this case).

Most of the that large list are things YOU have, not her. Rental properties can be managed from a distance (or else she could never leave India), bank accounts can be emptied 20 minutes after getting a visa..etc...etc...letters from third parties about why she 'has to' return India are as valuable as last week's newspaper. Your husband CANNOT accompany her to the visa window, nor will his presence improve her chances of getting a visa ( realistically his presence will harm her chances, because the consuls will immediately wonder...'why is this clown her? Her case must be weak...'...he cannot intimidate the consuls into giving her a visa...he will be lucky if he is not escorted out of the waiting area. A visa interview is a PRIVATE matter....no third party (except perhaps translators or care givers if the applicant is physically unable to participate by themselves) is allowed at the window....period....the more he rants and raves, the more the consuls will believe something is fishy. Best if he stays out of the embassy altogether.

I completely agree with Brother Hesekiel. The fact that you live in the US is doing more harm than good. You should have nothing to do with your mother's application. I was once told that anyone that applies for a B2 visa is looked at as having immigration intent. Therefore, your mother needs to prove this is not the case. Two very famous questions they usually aske are:

1. Do yo have family in the US?

2. What is the purpose of your visit?

Once you answer yes to question 1, the interview is over...visa denied! In my opinion, it will be hard for your mother to prove that her visa would be just for a visit. In the words of Brother Hesekiel " you need to disappear from the radar".
