CR1 Visa - Case Completed but would like to have the interview in the US

Good news. The Wife's Visa got Accepted and we now have to wait for the US Embassy appointment. The issue is that it might take up to 2 months

to make an appointment since the November deadline has passed. We have been separated for the last 3 months she is currently overseas, I live in the US.

I have the following questions:

1.) Can we make the Interview Appointment in the US? NVC mentioned that I will have to file for a change of status. Has anyone done this before?

2.) The Wife has a Tourist Visa. Can she visit me before we file a Change of Status or she could be denied entry?

1) No way

2) Probably let her in, but why on earth would you risk it when an interview could come at any time...she might just get here and have to return home

They will schedule the appointment in her country. Usually when one tries to travel on a tourist visa with a CR1 or K1 visa pending it can backfire at POE due to the fact they have an immigrant visa pending and end up being returned to their country.

9/20/2013 USCIS reaffirmed sent to embassy

1/04/14 Case opened for review

8/31/15 Interview- no questions visa approved on the spot

9/8/15 visa status issued

9/10/15 visa received

Entrance into the US is not a guarentee

Honestly she should wait. No way to interview in the US, she'll have to interview in her home country

Not sure why NVC advised you to break the law, having your wife enter on a tourist visa with intentions of adjusting status is visa fruad, can carry a lifetime ban
