I've had a situation with some similarities. I think you are not going to pull off getting your marriage declared void or annuled or anything like that.

I have not checked all the history you have provided.

It might be to your advantage to delay and or drop the divorce for now.

If she gets deported and you are not divorced you can send her what you feel like sending.

if she is in the Philippines when the custody hearing takes place that should work in your favor ( that's assuming she didn't take your son with her.)

Different states do have different views on divorce.

There could be an advantage to moving to a different state before you get divorced.

You would have to fulfill whatever residency laws the state requires.

Texas is a good state to move to if you are not into paying alimony.

California is a good state to move to if you want to pay alimony for the rest of your life.

I think once she is in PI without your son, her bagaining position sucks.

As your wife she does have the ability to run up your debt.

Once she is in PI you would be more in charge of what is happening.

You might be able to permanently postpone the splitting of assetts if you so desired.
