A Supreme Court ruling has forced the Government reluctantly to draw up new rules allowing serious sex offenders put on the register for life to have their place on the list reconsidered.

The Home Office plans were opposed by child protection campaigners and Conservative MPs, who said some offenders could never be considered completely “safe”. The new rules were drawn up because the Supreme

Court ruled that automatic lifetime inclusion on the register breached the Human Rights Act.

David Cameron said the ruling was “offensive,” but ministers say they have no choice but to comply by changing the rules on the register.

The case is the latest involving the Act to set judges against political opinion. It has increased calls for reform of the Act, which is being reviewed by a Coalition committee.

Under current rules, anyone sentenced to more than 30 months in jail for a sexual offence is put on the register for life on release. Those on the register are monitored by police and visited regularly by officers. The Home Office estimates that there are about 44,000 people on the register, about 25,000 of them for life.

Under the proposed rules, adults listed for life could apply for removal after 15 years. Their cases would be considered by police and probation officers.

Those under 18 at the time of their crime would be able to seek a review after eight years.

The Home Office estimated that the change would mean more than 2,000 people a year would be eligible to seek a review. Offenders whose applications are rejected will have to wait another eight years before being able to seek another assessment. The National Society for the Prevention of Cruelty to Children said it opposed allowing child abusers to be removed from the register.

A spokesman for the NSPCC said: “Our view remains that adults who sexually abuse children should stay on the offenders register for life as we can never be sure their behaviour will change.”

Priti Patel, a Tory MP, said the court ruling added to the case for reform of the Human Rights Act.

“Sex offenders are vile criminals,” she said. “Why are these people allowed to use human rights laws to protect themselves? What about their victims?”

This is not the first case of the Coalition being forced to introduce potentially controversial measures at the behest of judges. Ministers are drawing up plans to allow some prisoners the vote after a ruling from the European Court of Human Rights.

Mr Cameron told MPs in February that the court ruling on the register “flies in the face of common sense”. He ordered an appeal, which was rejected in April, forcing ministers to draw up the new system.

Despite ministers’ reservations about the change, the Home Office’s “impact assessment” study suggested that it could bring some benefits. Removing some people from the register would mean that “police resources may focus on those offenders who pose a higher and continuing risk,” it said.

The department said investigations suggested that not all the 2,000 offenders a year eligible to apply to be removed would do so. It predicted a maximum of 1,200 offenders would apply for removal.

Some experts and campaigners believe that several offenders present a permanent danger, justifying permanent restrictions on their freedoms.

The Home Office said it was impossible to say how many, if any, applications for removal from the register would be successful. But Harry Fletcher, of the National Association of Probation Officers suggested that very few applications would succeed.

“No doubt there will be no shortage of sex offenders who will want to appeal against being on the register because of stigma and shame,” he said.

“However it is highly unlikely that any will be successful. To be removed, the individual will have to prove that they are no longer a threat to women and children and this will be extremely difficult.”

A spokesman for the Association of Chief Police Officers said some sex offenders would always pose a risk, but backed the review plan.

“The reality is that the risks posed by some offenders can never be completely eliminated,” he said.

“But we will continue to do all in our power to keep them to a minimum and believe that the proposed review process strikes the right balance between individual rights and public safety.”

Anticipating public unease about the new rules, the Home Office also proposed tightening the conditions applied to people on the register, forcing them to give the police their bank and passport details and notice of any foreign travel.

To stigmatize a 17-year-old kid for life for something as silly as having consensual sex with a 15-year-old?

These people are either a danger to society or they're not. If they are, keep them locked up. If they're not, they have the same rights as you and me, which includes not being on any government watch lists.

What non-Europeans can't see is that the UK is a civilized place where people are not tortured and executed for a very good reason

That reason is that people are regarded as human beings whatever they have done, and the purpose of sentencing is to keep the public safe in future rather than the savage retribution which is the primitive motive in the USA

If a person committed a minor offense many years ago and has since grown up, it's sensible to take them off the register.

Vindictively grinding them into the floor for the rest of their lives helps nobody and imposes a cost on society

I know that's a bit sophisticated for the mountain boy lynch mob in south carolina/texas etc to understand, but civilization and careful consideration not fueled by blind vengeance, is not learned overnight

The difference is apparent with the Herman Cain thing - a woman allows herself to be put up in a beautiful hotel suit, allows herself to be wined and dined, and then cries outrage when the man puts his hand on her knee. In her mind he should be branded a sex offender for life and banned from all livelihoods.

Its a very different country and the culture difference is very apparent

True pedophile's have a problem that I don't believe can be "cured". It is what they are sexually attracted to. Just like a gay man or woman are attracted to members of their same sex and some straight men are #### men or ####### men or leg men or eyes or blondes or red heads, etc, etc and women look at car, job, chest, arms, etc, etc. It's what they're attracted to. With pedophile's it is either young boys or girls and that can't be fixed, changed, cured or whatever is the politically correct word to call it. They need to be on list's, prisons, psychiatric hospitals, medicated, castrated or something. They can't be out lurking and be a potential danger to innocent children.

We had some sicko in this county a few months ago, who asked an 8yo girl in his neighborhood if she wanted to see his pet birdie. They reported it to police, they found it to be baseless. 2 weeks later he kidnapped her, sexually assaulted her and then killed her in the basement of their apartment building. He should have been on a list, her parent's shouldn't have allowed her out of the home unsupervised and Dad should have whooped his #### after the 1st incident didn't get any law response. This other sicko up at Penn State, same thing he had a grand jury investigation they found to be baseless and then he felt emboldened and continued on with his sick ways. Call it backwards Southern/Texas or whatever you wish, if you like to prey on young kids for your own sexual gratification, in my book then you should be villified for the remainder of your days on Earth.

The cases involving someone whose SO is 16 and they're 18 are quite ridiculous and anyone with any common sense knows they're not a danger to society.

That sounds very sensible and I agree with all of it

However, I feel very sorry for some immature kid who experiments and ends up on these registers when they are harmless and grow out of it.

Even if the allegations against Cain are true, these people on telly who make out its close to attempted rape and want him on a register are ridiculous.

Every 13 year old boy who has tried a feel in the back row of the cinema would be on the register for life according to the pilgrims in Mississippi and Alabama and South Carolina

We have the same neanderthals in England. A 15 year old retarded (can I say that) boy exposed himself to my 6 year old daughter and I reported it to the police. To my amazement, my wife's slope-foreheaded family criticized me for not going round and pounding the boy to pulp.

There is too much extreme behavior by people who have no boundaries in their unordered lives and who do everything by ill-considered knee-jerk reaction.

In other words lynch-mob mentality.

This is what is wrong with representative government US style where the congressman is simply the mouth piece of the people and not an elected person who votes their own conscience, as in England. If the people are crude and vindictive and ignorant, the representative has to represent their unmodified desires in congress.

Hence firing squad executions in Utah and and 13 year old brides in the confederacy etc etc

You have to take the Herman Cain stuff with a grain of salt. They're(MSM aka mainstream media) trying to vilify him, because they're afraid of 2 men of color being the nominees and actually having it come down to a battle of ideas and possibly splitting the minority vote. This goes against their belief that people of color could actually be Republicans. Actually on The Today show this morning David Gregory said that Cain's sexual harassment allegations are a problem to the GOP, but there's no Grand Wizard in the party to really force the issue. Everyone alive from USA knows that "Grand Wizard" is a KKK reference. But if this was said by anyone on the right, regarding a Dem they'd be forced to apologize and then be fired. So you have them(MSM) on one hand stoking the fires of this to make it to be more than it actually is/was, while at the same time trying to pass on the myth that the Republican's are not an inclusive party and are just for rich white people. It's a helluva switcharoo they are able to do the sheeple.

I hope your daughter didn't have any lasting trauma from her experience and I hope the Police did take some action against the boy "retarded" or not. If they didn't, I'd be on the in-laws side and wouldn't have faulted you or any of them one bit for slapping around the sicko some, I'd probably have donated to your defense fund if it became public that you were charged with some crime for doing so. :o
