Applied for AOS - my husband lost his job

Timeline

Hi journey friends,

We filled out the paper work for the aos process ( I-485, I-131, I-765). We attached all documents going with the application. The paperwork is dated, signed for 11/1/11. We had to wait for the letter of employment to be signed by my husbands boss which is dated with date mentioned above which he received signed, yesterday. So the package was therefore complete and I mailed it out today around launch time ... right after that my husband called me to let me know that they had his job terminated as of today.

He likes to fill for unemployment tomorrow. His unemployment as of now will be higher than minimum wage. My question can he file for unemployment until he finds a new job with similar pay or does he need to jump the gun and take anything possible ...how does it affect our application? Is there anything we need to do?:crying:

He can file for unemployment and try to find another job in time for the interview.

If you two have sufficient assets, you can try using assets only. I believe the requirements call for assets three times the minimum for the household size.

He should file for unemployment as soon as he is able and then look for a new job.

Have a co-sponsor lined up if you need to, but the lack of work *right now* will not affect your application. However, you may be asked for more information at a later time, concerning income, so you should be prepared.

With the processing time, he may very well get a new job. If that happens, arrange to have the same info available for the I-864 if needed.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
