Can my wife receive a learners permit/drivers license?

We are currently AOS'ing from her J1 visa. She has a SS# (for work only). Can she get one of these licenses and if so, how?

10-4-2010: Married in NYC

10-17-2011: Sent in I-130, I-485 Packets

10-21-2011: Package received by USCIS

10-28-2011: Received I-797 forms for I-130, I-485, I-765

11-9-2011: RFE received for missing medical exam

11-22-2011: Biometrics

11-28-2011: Civil Surgeon medical exam

11-30-2011: Sent medical exam for RFE

12-5-2011: RFE received by USCIS; Case sent to NBC

12-15-2011: Interview set for 1-17-2012

12-28-2011: EAD card received

1-17-2012: Interview at NBC- Approved!

Depends on the state rules - but most need current USCIS docs to proceed.

For example, you may need the EAD from the AOS to get the license. Then the length of the license will based on that.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

my wife just got her EAD a couple weeks ago and we went right to the DMV. She took the test and passed and then they validated her Russian license and she didn't need to take a road test. This was NJ though. I would check with your state DMV website for what is needed to get a license in your state.

04-17-2011 Married

08-01-2011 AOS Packet sent (I-130,I-485,I-765) via USPS Priority mail

08-03-2011 Package delivered via USPS tracking

08-08-2011 Received Text/Email that all 3 apps were accepted/Checks cashed

09-06-2011 Biometrics Appt. in Philly

09-14-2011 RFE Sent for 485. I forgot to sign one section of the 485

09-21-2011 RFE Mailed back to USCIS

10-14-2011 Card production of EAD ordered

10-17-2011 Interview notice (I-797C) received for 11-16-2011

10-22-2011 EAD Card received

11-16-2011 APPROVED. Card Ordered, Passport Stamped.
