Hi, I am getting all my paperwork ready for the marriage based greencard application (I-130 and I485 filed together) to file within the next week. I am currently on a J-1 visa till mid March 2012 and I wondered whether I should already file the I765. I would get a new contract from my current employer (at least if I have a visa or work permit starting March 2012). Would applying for an work permit change my current J1-visa situation? Any help is greatly appreciated!

Are not subject to a two-year home-country physical presence requirement?

Or did you already get a waiver?

I'm on a J1 Visa and I applied for an EAD, primarily because my J1 expires at the end of this month. I am currently employed but I didn't have to start a new contract with my employer, I just showed them my EAD to show I can still work after the expiry of my J1.

I'm still trying to clarify my situation with income tax, as under the J1 there was some tax exemptions, so i'm not sure when I'm liable to start paying certain income taxes from when I got my EAD or from when my J1 expires.

Filed AOS, EAD & AP: 15 Sep 2011

Received NOA: 23 Sep (dated 19 Sep)

Biometrics Letter: 29 Sep

Biometrics App: 20 October

Called and sent letter to congressman :24 Oct

Call from congressman saying EAD &AP is approved :25 Oct

Email from USCIS that EAD ordered and AP approved: 26 Oct

Received RFE for tax return: 26 Oct

Responded to RFE: 31 Oct

EAD & AP received:2 Nov (Day 49)
