I have a question about the I864, I am yet to get my NAO2 however I proactively completed my i864 and i864A forms last night. This is the story:

Tax of 2010 was for work period of August 2010 to Dec 2010 (New grad)

I claimed two of my siblings on my taxes for 2010

This put me 500 dollars short of the 125% of the poverty guide line for a 4 people household (Myself, husband and two siblings)

However my projected earnings so far for 2011 will put me above the poverty guidelines for 4, especially if I present my pay stubs.

To be on the say sides I called my mom for back up (so 500dollars doesn't delay or hinder the process)

My mother then files the 1864A for me and both our earnings for 2010 is way above the requirement.

My question:

Do I really need to use my mom as a joint sponsor esp. if I can prove that I earn way more than is required for 2011 (without filing the 2011 taxes)

In 2010 my mother sponsored both my siblings I130 and I864 and I turned around and claimed them in my taxes of 2010 cause I helped them settle in financially.

I am trying to prevent a messy situation that could result in delays and RFEs'

If you are a new graduate, be prepared to provide a joint-sponsor, even if you are making good wages now. So take a I-864 of a co-sponsor to the interview, even if you don't need to submit it at NVC.

My 2010 wages were less than 125% for me and my wife but my 2011 wages were good, so I used just my I-864 at NVC. It was fine. But my wife was asked if she can provide a co-sponsor to make her case strong at interview and we provided my dad's I-864.

If you claimed your siblings as your dependents, then they will be part of your household (4 = you + spouse + 2 siblings). If you are living in the same house as your mother, then you can use her I-864A with your I-864 else she will have to file I-864.

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)
11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

First quetion is how are you claiming siblings as depentents ? It isn't a normal thing and maybe you shouldn't be doing that which would drop your household size and then mean you need less income.

Your response is not clear!!! My siblings immigrated to the USA newly and they stayed with me for that period hence I provided all their support at that time.

Thank you very much... My mom filed the I864A and all am waiting for now is my approval from USCIS
