What is my chance to get permanent Green Card after divorce?

Here's my situation:

I used to be an F-1 Visa Student. I met my ex-wife in 2005 and we got marriage in August, 2007. After that she got accepted from one of the UC school in North California, then she went there for studying. But we still went back and forth. Then in 2008 she got her citizenship and we applied for my green card.

In July 2009, we had an interview and I got my 2 years green card. I had treated her and her family very well since the day I knew her. I paid everything from phone bills, insurance, airline tickets...and did everything to protect our love but around 2009, she had an affair with another guy. I felt very sad and disappointed about her. However, things didn't work out with them and they broke up. Then she came back to me and wanted to rebuild our relationship, and I accepted because I still loved her so much. But one more time, she broke my heart, she had another relationship with a newer guy and now she wanted to get marriage with him. So, she filed a divorce without thinking how I felt in 2010. I had to apply the waiver for removing my condition with the help of my attorney, hoping to get a permanent greed card so I can get a better life. Here's what I sent to them:

  • Our tax-return 2007,2008,2009.
  • Our joint bank account(we don't have any property because we're still students)
  • Credit cards
  • Out T-mobile phone bill.
  • My insurance with me and her name on it
  • Lots of our picture since the day we met( back to 2005)
  • Receipts that showed we went to Vegas every year.
  • Lots of hotel and airline ticket receipts that showed I went to visit her while she was in University.
  • Receipts that I bought gifts which were sent to her address when she's at school
  • Valentine's cards that we sent to each other.
  • 2 letter(one from my previous landlord, he's also my best friend, saying that we are a real marriage couple), and another one from my friend.

The immigration got my application in April and I got all the fingerprints checked, extended status... but in August, they asked me for more evidences(such as bank count which I already sent to them) so I resent those bank statements, but my attorney asked me for more new evidences but that's all I had, so I decided to send our intimate video clips when we lived together.

And I've crossed my fingers and checked my status on Immigration web page everyday. Then just couple days ago got a letter from Immigration Office said that they relocated my case to Santa Ana location and Santa Ana office will notice me when the interview is available.

I'm so frustrated because of my status and my future. Do I have any chance to get the permanent green card? And it's been a while (7 months) for them to process my case, is it a good or bad sign? Also, what are the questions they usually ask in the interview? Please, someone helps me, I don't know what to do now :(

I apologize for a long post. Have a great day!

hi, I am sorry that you're going through this delay after all you had to go through with your ex. I know how it feels :(

you might want to check our Removal of Conditions - Waiver timeline at: http://www.visajourn...e/page__st__465

I studied what happened to everyone like us so I could understand the possible timings for my own case. for me, after I sent documents that I knew were missing at the time of filing (divorce papers not concluded yet), it took them 6 months to review, in a total of 8 months for me since the day I mailed the package. but they did not call me for an interview. From analyzing the timeline, you will see that there are more or less the same timing for similar cases - i.e. 3 months when there is nothing missing, 6-7-8 months when there is something missing and they send a RFE, and so forth...

Did you guys have a signed lease together? You might want to gather more stuff like this or really anything else you can find from your time together in case they do call you for an interview... print screen shots of this video you have together or so. Your docs seem more or less like mine, but I also sent the lease one. Good luck and hopefully you will be able to move on with your life soon.

You sent vids of you having sex? Just FYI they don't look at those and ick.

You explain the situation and you stand a chance. Otherwise you go home.

Thanks for you guys input! I'm very appreciated it.

@ Resilient: Thank for your advice, but I don't have the lease agreement, because that has been a long time and I can't find it. However, my ex-landlord wrote for me a letter to show that we had lived there as a marriage couple, hope this will help.

Do you guys have or know any experiences in an interview, please let me know. Thanks!

I really hope they meant them at home together, watching TV, etc. when they said intimate and not sex! I would think sex clips would probably be a whole different kind of red flag!
