Hi,

So, I have not filed my US taxes for two years. I don't owe anything, in fact, they owe me. I'm just supposed to file them every year that I've been here, which was 2006-2009 (for school, then OPT) so, now that I'm here on a K-1 and awaiting AOS, I'm wondering if this will have any impact. I will do them asap, its just a matter of waiting on copies of my W-2's. Also, I have a W-2 for work that I did in 2009, but they gave me it for 2010 because they were late paying me...and technically I never received the money since the check went to my fiance in the US. Any thoughts? I'm thinking its not a big deal, but just got a wave of paranoia.

it will not have an effect.

However, you should file, even if they owe you money - you might get more back then you think.

Also - it's not good to underestimate what the IRS might do later...

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

yup. w-2'a are on the way...I even tried to file while I was in canada, but for the love of god....my fiance never got me the W-2's no matter how many times I asked him!!! (......guess who put together the ENTIRE k-1 package/AOS package) LOL! but now I'm here and its down to business. Thanks for your reply! :)

p.s. I like your "worst case scenario" idea. I try to be of the same mind.

With the fees we have to pay for K-1 Visa and then AOS/AP/EAD is there a proper way that I can claims these fees on my taxes?

If so which form and which section?
