Good point.

Not trying to be heartless, but I dont want you to get in trouble by candy-coating this issue. It doesnt seem fair because she would probaby get free assistance if she popped up in Laredo with no documentation. Since you played by the rules, they have you on the hook to provide 100% of her care.

I would still check first with an attorney experienced in immigration law, of find some Pro Bono or low cost help . Here is a link to the Texas Bar Association that conducst Pro Bono clinics were you can get some free assistance with the issue.: Texas Bar . The good thing is that you still have some time before the bills roll in !

Remember your affidavit of support? Guess why they made you fill that out, so your spouse would not be a burden on the US taxpayer. This may disqualify you from public assistance, or trigger notification to USCIS that you are seeking public assistance in violation of immigration statutes that you agreed to in your affidavit. I wish you best of luck, but be carefull, there is a reason they are asking for immigration information.

There was already a discussion on this today in the k-1 forum titled Food Stamps

and if you follow Vannessa&Tony's link you will see that WIC does not qualify a person as a public charge

I would highly recommend that you seek professional legal assistance on this issue from an immigration attorney that is licensed in your current state of residence, . Somethng so serious shouldnt be navigated using information exclusively from the internet. This is a complicated issue that traverses both Federal and State statutes which can and do change on a daily basis.

Just my two cents, take it or leave it...

I think maybe you are talking about the 'Tax Number' .. I've always heard of it referred to as an Alien Tax Number or something like that. I mean, I could be wrong but I'm thinking that might be what you're talking about.

It is not the same as the A# or Alien Registration Number. The Tax Number is like a special number that's issued to aliens or alien spouses by the IRS that is just for tax purposes only. It's kind of like the substitute for her SS# that you use when you do your taxes and you need that number if you're going to file for a joint tax return with someone who doesn't have an SS#.

Timeline:

02/04/2004 - A young Zinker arrives in Mexico to study Spanish and the dating game begins

2004--2005 - Many subsequent visits to Mx ensue to be with my love; engaged in March 2005!

04/??/2005 - I-129F is filed from within the US

06/09/2005 - Zinker moves to Mexico

09/??/2005 - I-129F is approved

10/15/2005 - Interview in Cd. Juarez and subsequently approved for a K1 Visa!..But visa is left in Juarez

10/17/2005 - Due to unexpected pregnancy and a job offer in Mx - we decide not to pursue the visa and it expires :(

01/04/2006 - Married in Mexico

10/09/2011 - Two children later and a comfortable life in Mexico... Preparing to file I-130 in December 2011. Stay Tuned!
