Need help understanding I-130 and some information

Here's a little something about my story.

I'm 26 years old and a US Citizen. My husband is 28 years old and a non-US Citizen. I was born and have been living in the Philippines all my life. I came to the US February 2011. I've been staying and living here for 9 months now. My husband is still in the Philippines because I have not yet filed a petition for him to come over here in the US. I've been doing some research about what to do and how to start. By the way, we got married in the Philippines on September 2007. So, we've been married for 4 years and 2 months. Anyway, I've been in the US for 9 months and been working for 3 months at Macy's in Texas. I'm trying to get a petition for my husband so he could come over here and be with me. Also so that we could live and work here together.

I called the USCIS for some information about the I-130 form and other forms needed along with it. The man said it usually takes 5 months for the I-130 to process and in some cases lesser than 5 months. He also said that if approved, they will send the form and other documents to some office for them to review it. He said it would take 3 months or so for that to process. I told him that my husband was in the Philippines. He said that they will send a mail to me and one to my husband in the Philippines for any additional documents if needed or a letter saying something about an interview. I asked if when the interview is dated, how long would it take for his visa to be approved. The man said that my husband will know if it was approved or denied on the same day of the interview.

Well, I just want to know if all the information about the time frame is true or would it be longer than what the man told me over the phone? I really do want my husband to come over here in the US by next year (2012) or before Christmas so we can spend Christmas together. One more thing, how long do you wait before getting an interview? Do you get it like 3 months later your I-130 has been approved or you wait more?

Christmas will not be a realistic expectation. It won't happen. Sorry :(

Yes. The average for the acceptance and approval for the I-130 can take up to five months if you do not have an RFE. If you do have to send in more information, that can add another 30 days or more.

Then it spends about 2-3 months at the National Visa Center.

It is then sent on to the embassy, wait times for consulates vary.

In total you're looking at an AVERAGE of 9 months from beginning to end.

Yes, the man you talked is right....I-130 takes 3 to 5 months to be approved (In our case, it's 90 days - CSC). Then, after approval they will forward it to the NVC which is usually takes 1 month to get your case number. After you will get your case number you will submit your Affidavit of support packet and he will submit the DS230 packet. If there is no problem with your documents, your case will be complete 7 to 10 days after you completed the documents. Then, NVC will schedule you an interview which usually takes place 1 or less than a month after your case is completed (It depends on the consulate too, if there are more slots open for interview.)

filing i 130 is the very first step in this process. depending on how quickly (AND CORRECTLY) you submit the necessary forms and required documents, you can probably get an interview appointment in about 9 months.. IF you do everything correctly and they find nothing questionable...

Since you are married, I believe you are filing for an IR 1 which is a petition for Immediate Relative. After you submit the i 130, you should get a response between 2-3 months stating if the application was approved. After that you will most likely be instructed to pay for and submit an Affidavit of Support. which is usually the next step... Good luck!

If you are a US Citizen and you are sponsoring your spouse, you get a CR-1 visa. There is the application fee, medical fees (will vary from country to country and whether your spouse needs immunizations) and the fee you pay when scheduling or at your interview at the consulate. Montreal is $355.00 I do believe.

Then you have to take into account re-location fees to move to the U.S.

Thanks guys! What other payments are charges for the applying for all of it? I know you pay $420 for the I-130 filing fee. Any other more payments or costs?

Lots more:

I-485 Affidavit of Support - $88

DS-230 Immigration Visa Application & security surcharge - $404

Medical exam - varies depending on doctor and country

Police Certificate - varies depending on country

AOS FEE - $88

IV FEE - $ 404

MEdical Fee @ St. Lukes - P9,387.50 pesos (Depends on the Exchange Rate of USD)

NBI - 115
