what a nightmare process, still hopeful and waiting and praying

this process has been long and stressful but i am still hopeful that something good will happen. but i must say for much of the past....17 months or so....has been pretty stressful and frustrating.

a quick back story: i am married and my wife is a us citizen. i have an A-2 visa (out of status) which derived from my father who worked for my country's embassy in NY. about a year ago my wife on my behalf, and i, filed I-130/I-485 to adjust status. the process was long, with USCIS asking for more documents throughout the year. finally we get scheduled for an interview, which was rescheduled because my wife was away on business, and our interview was last week.

so our interview was in newark, nj. we get there early, around 9:45am and waited until 2pm. nobody said anything to us, we just waited and waited.

so finally my wife says she has to go to work and a woman says she will see us soon. about 2:30 she decides to call us in for our interview. she realizes that my wife has to go, so she takes some documents from us (pictures, insurance cards, bills, etc) and then asks my wife some questions for about 2 minutes then tells my wife she can go, but i should stay behind for further questions.

so my wife leaves and i stay to be questioned by this woman.

she grills me for about 20 minutes.

she then makes me fill out I-566 and I-508 while im still there but there are some information that i dont know. so she tells me its ok she will call me tomorrow and get that information from me. so i leave my number, but the next days he doesnt call me.

two days later im frustrated about not being called so i take a trip to the newark office with a properly filled out i-566 and i let the woman at the window know that its for the woman who interviewed me two days ago, her name is on the envelope. she tells me to wait and she goes to get the woman who interviewed me.....who then comes to see me and apologises for not calling me. she says thanks for bringing the form.

so what will happen now? how soon can i get or expect a response?

i feel like nobody is really paying attention to my application and the only time somebody does something is if i complain or request that somebody look into the matter. its been almost two years now and the wait is taking its toll on me.

the only thing keeping hope alive is that they have not denied the application, so im just waiting for an approval letter with green card

Filed: K-1 Visa Country: Vietnam
Timeline

The I-566 and I-508 should have been included with your I-485 adjustment of status application. An A-1 is a diplomatic visa. USCIS will have to clear you with the Department of State, and possibly with your country's diplomatic mission, before you can become an immigrant in the United States. Some countries don't like their diplomats or their dependents immigrating to the countries where they are assigned, and USCIS isn't going to do anything that might cause a diplomatic row with your country. In other words, this is far from a typical immigration case.

We don't see too many of these cases on VJ. I suspect the extra processing will take some additional time.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

  • 1 month later...

this process has almost been one year just for the i485 alone. it was filed in march 2011.

they said interviewer has up to 90 days to make decision, and that will be in February 2012.

so just less than 2 months i will know good or bad.

such a long process

Jeez. Once again I am in awe of your knowledge.

If you don't mind my asking is your work related to immigration or do you just like to soak up knowledge?

To the OP I hope everything gets sorted out quickly and that this is indeed just a formality.

still waiting, as of january 3. at this point i am not too thrilled about my prospects, but im still waiting since i was told it can take up to 90 days for a decision. i dont know whether i should go to the newark office and ask about my application or if i should wait until after 90 days and then make an appointment to go and ask about my application.

but this is causing me tons of stress. i updated my timeline, not much to see there but its been updated anyway.

but again, im just waiting at this point. not much else i can do!!
