Hi! yes, CR-1 looks like the one for you especially if you're in no hurry. You'll be issued a green card which is legal permanent resident. No need to be a citizen, and you can work, and travel outside as you please. I believe if you leave the US for more than a year without a waiver, your green card is considered abandoned. Otherwise, you can come and go as you please. Check out the guides and just poke around this site as it is all you need. You do NOT need a lawyer. They suck, and cost you tons of money and this is something you can do yourself with the guidance of VJ! good luck!

To ease your mind a bit. Many people get into a bit of trouble now and then. As long as you did not commit such a horrific crime that it made international news, murdered more than 10 people, pillaged a small country, or did physical abuse to a woman, a small police record very very rarely prevents some one from getting a visa. Just be honest.

There are a host of relatively minor crimes that can make someone inadmissible. Many of these are crimes that often wouldn't even result in a jail sentence or probation if they had occurred in the US.

Assault can be considered a Crime Involving Moral Turpitude (CIMT) if:

1. There is intent to kill, rape, rob, or do serious bodily harm, or

2. If a dangerous or deadly weapon is involved.

Simple assault (e.g., getting into an argument and punching someone in the nose) is not a CIMT. The CO will have to review the court transcripts to determine if the crime makes the OP inadmissible. The fact that he was cleared for ESTA after declaring the crime leads me to believe it won't be an issue, but it's not a guarantee. They don't screen people as thoroughly for ESTA as they would for an immigrant visa or a visa that allows for immigrant intent.

Aww, cheers guys! Thanks for all the replies! No offence taken haha, it was basically a pub fight, a guy hit me so I hit him back and he came out worse off than I did, hence me getting arrested, a few moments of drunken stupidity 8 years ago, it was just fists there were no weapons involved.

As I said before I did not declare it on the ESTA as the way it's worded on there seems to be pretty vague and could cover a whole spectrum of stuff and I didn't believe I fell into the bracket of what they were asking. Now however, as me and my fiance want to marry and I will need to start applying for visas etc I don't want the fact I have not declared it to go against me.

I have nothing to hide and will be totally honest on any paperwork or any interview I will become involved with.

I'll dig around on here, speak to my fiance and decide which route is best for us to go down.

We are going to have the same problems with her, as she would like the same freedom in the UK, we plan to spend time in both countries, she however has never been convicted of anything!

If you get married in the Bahamas you want to go the CR-1 route. You may want to marry on US soil, get your travel authorization then go to the Bamahas.
