I obtained my greencard through my ex-husband. We are legally divorced but I didn't switch back to my maiden since all my documents were in my married name. I would like to remarry. What do I have to do in order to get my new last name changed on the greencard? Which documents do I need? Or can I just leave my card in the old name? :help:

anybody?

If you want to change the GC you need to file (and pay for) an i-90. That's $450 (from memory). My opinion is you should change it, it IS your legal name... but it's a ####### load of money. There was also a post recently where the OP had document in her new married name (passport, drivers licence etc) but her GC was in her old married name... that caused a bit of stress for her.

In order to change your last name you need to file for http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=b3f7ab0a43b5d010VgnVCM10000048f3d6a1RCRD&vgnextchannel=db029c7755cb9010VgnVCM10000045f3d6a1RCRD

Thank you so much for your answers. :)

I've looked at the form and the copies they need but I'm a little concerned now. I received my 10 yrs Green card at the beginning of February. My husband filed for divorce at the beginning of July and it got final at the end of the month. At court we were asked if we have been living separated for at least half a year and my ex stated that we didn't even though we were still living together (I moved out on the day the divorce got final). He had another girl next to me. I had no clue about this until April when he dumped me in order to marry this other woman.

Here is my concern: Since I obtained my 10 years GC in February but he stated that we've been separated since the end of December while I was still waiting for ROC to get approved will that cause a problem for me?

I didn't know about this half year requirement when we got divorced. I was hurt and devastated and just wanted to get away from him after what he's done to me and so I didn't say anything to the judge. Now I was wondering if I will get in trouble if I change my name to my maiden name or if I ever get married again and changed my name or even if I file for citizenship one day? :(

Well.. did you have an ROC interview? and when did you file ROC?

I filed ROC at the beginning of August 2010. I thought everything was fine until April 2011 .

We had no interview.

Well then you're fine. If you'd had an interview (and "pretended to be still together") they could have claimed fraud but you weren't divorced until AFTER you got the GC so you didn't break any rules.

No problem :)

That's good news. :)

I'm just confused because I've read that I would've been required to file on my own since he claimed we weren't together anymore while ROC was still in pending?

Nope. You can ONLY file on your own based on divorced (which you weren't yet) or based on abuse. You filed jointly because you were still married at that time (and you filed in August but he claims separated in December so there was no lie in that). I think you will be fine. BUT for the record it's never good to lie (as you now realise) no matter how easy it seems to make it in the beginning, because it just creates issues. The card was issued 2 months after you "separated" but before you divorced. So I think you'll be completely fine.
