I met my girlfriend this summer on a work or student visa. i am going to see her next month in her country (romania). she is planning on returning in july of next year (2012) on a work visa. if i marry her next year upon her arrival, does this mean she can stay untill she is apporved permanent residency through the k-3 process? if not, does she have to leave after her work visa expires, then she can only return when i apply for a k-3 visa for her (if approved)? in the i-130 form, if my income doesnt meet poverty level to suppport both of us can i use assets of hers? she has an assets of 50,000 dollars that she will be given by her parents, so would this assets NEED to be included for better approval if my income doesnt meet the requirements? is it considered both our money, seems how we will get marrried before the k-3 process? please give any advice if you have any, thank you .

She could adjust status after marriage, but that's not a K3 process. It's just "adjustment of status". Read the I-864 instructions for how to use the immigrant's assets and income and this guide to complete the process. http://www.visajourney.com/content/i130guide2 Yes, she can stay until her status is adjusted.

Facts are cheap...knowing how to use them is precious...
