4.Ok this is the scoop 1. They said I could not prove I lived with my wife. (I did have paper work from welfare, drivers license, lease car title)

The problem is that I used a store address for school a year before I got married. I had the landlord at the business clarify that still it did not work.

5. They said that I did not prove battery. Well they got the restraining order tho.They did not say much about psychological effect. The police report was only a claim I made according to them. The police did not see any slap mark on me.

They said my affiants did not indicate to have seen anything done to me.

7. They assumed that the marriage was not in good faith but they did not give any reason.

I don't know how to begin here Please find the attachment I put up. I could not upload all of it. They have a global limit on here. Hopefully I will figure it out soon.I should not have sent the bill from school it was a mistake and they used it against me. So when can I start to refile? Refiling: it seems to be a better option. That way you can be correcting the error with a new officer.

I am sorry for you Harry66.Like I said you need to put yourself together in order to fight this battle.The only option you have in this situation is to refile.Work on the things they said are the reasons for denial.If possible re-write your testmony.I didnt have a polic report ,no medical or counseling report,but my testmony and affidavits from friend who witnessed the abuse helped.I sent documents to show that we lived together even though we didnt have joint mail as my spouse was controlling I only sent my own mails,marriage certificate ,birth certificate of our son,pictures of our wedding,letter from shelter I had gone to seek help,tax returns we filed together for the past 4 years.Like I said people have all the evidence but still get denied why becuase of how they write their testmonies.Your testmony is the main key as you are the one that knows exactly what happend and when you send your application your testmony is the first thing they look at ,take your time in writing it and be as truthful as you can dont add what never happend becuase those people are good and can pick up,you may not have supporting documents like in my case I never called the police becuase I was scared at that time thinking I would be deported I also feared that I would never see my son.Though now I know all that was a lie that somebody used to control me.Also testmonies from friends should atleast be consitance with yours.Wishing all the best and please do it as soon as possible before they put you in remove proceedings becuase that will be another issue going to court which may even cause your application delay.

Timeline

Wait for the denial notice.Once you have received it read through and understand why they did deny your petition.PLEASE DONT APPEAL "CAUTION" its rare that denial through appeal is overturned.The best that you can do I think you have 30 days re-apply and submit also the reason why they denied you in the first place I am sure which was supposed to be RFE.I know i-360 vawa petition is free so it wont cost you a thing and appeal is like $700 which like I said its rare to be overturned USCIS dont make mistakes on vawa denials.Best option is to reapply and many received approval after first denial ,all the best also go to the vawa forum you will receive a lot of help from people who went through what you have gone through as in "Denial"
