hi, i arrived here in the usa 2wks ago as an immigrant and still waiting for my green card , i have a live in partner and 2 y.o. daughetr in the phils. what is the fastest way to bring my family here. thanks for those who will reply

How did you immigrate ? DV lottery ? If you are not married, that you can't anything until you become US Citizen (5 years), then it will take ~year to bring her as your fiancee. If you are married or will get married soon, you can bring her as LPR spouse - approximately 3 years waiting for visa number.

You could do a follow to join for your daughter, she could come in a couple of months, then go back to the Phils and marry your partner. You will need to file a petition (I-130) for your partner and will be place in the F2A category, the current waiting time is over 2 years.

If you aren't married there is nothing you can do for your partner. Assuming your partner is the opposite sex then you can marry then petition them and the wait will be about 3 years.

This will not be over quickly. You will not enjoy this.

If you are the primary beneficiary of the immigrant visa petition, and if you are the biological parent of your daughter, then she qualifies for a derivative visa based on your petition. You can send her visa application to the consulate any time, but her visa must be issued within a year of when your visa was issued.

If you are not the primary beneficiary, and you yourself got a derivative visa based on someone elses petition (a parent, most likely) then your daughter would not be eligible for a derivative visa. If she's your biological daughter then you can file an I-130 petition as her LPR parent for an FB2A visa. Current waiting time for an FB2A in the Philippines is close to three years.

Your partner is not eligible for any sort of visa based on their relationship to you. If your relationship is not same-sex, and you decide to marry, then you can file a petition for an FB2A for your spouse. If your new spouse is the other parent of your daughter then she could get a derivative visa based on the petition for your spouse. However, your spouse could not get a derivative visa based on a petition for your daughter. Derivative visas are for spouses or minor children of the primary beneficiary.

You'll be eligible for US citizenship in five years. If become a US citizen then you can petition for a fiancee - again, if not a same-sex relationship. The visa categories change - K1 for a fiancee, CR1/IR1 for a spouse, and IR2 for your daughter. Those are immediate relative categories, which means no waiting for the priority date to become current. As soon as the petition is approved you can proceed with NVC processing and the consulate interview.

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!
