Hello,

I have a question (or better to say need clarification) about tax filling requirements. I was trying to find this info elsewhere, but there are various answers.

We all know that LPRs are required to file tax returns. The problem is that hubby and I did not file for 2008 (came to the USA on November 19th, and hubby was unemployed while overseas. We had a joint sponsor.) because we had $0 income. According to the IRS, we were not required to file. We filed jointly for 2009, 2010, and going to for 2011. My question is what document can I send to prove that we were not required to file (if any)? I have read something about 1722 form (Verification of Nonfiling). Would this be sufficient?

If filing for marriage and have 2009-2011 tax returns, that is all you need. I tossed in four years of returns as a hint as to our long delayed process, wife said her IO was irritated by that. Don't even need tax returns for the five year.

Thank you! I am still not sure when I am going to file. Right now, I am looking into the whole process. It is a big decision to make.

So, if I file in 2012, then I will have to show taxes for 2009-2011?

If like last year, the IRS never even had the forms completed until mid February, thanks to our congress that would rather fight with each other than get anything done. Could try that explanation, but risky, depending on your IO, not a board, but just that one IO. Or just wait a couple of months. Tax returns are the key evidence the USCIS looks for as proof of a happy legal marriage.

And you don't need income to file a tax joint return, depending on your circumstances, IRS may even send you a couple of bucks. While we fight against socialism, very much a part of society. Just got my gas and electric bill, have to pay for people that cannot pay. Only thing that is important, the energy companies get their money and our legislators made that law.

Thanks NickD. Nah, I will not do anything risky in that respect, and waiting till April might be even better. I was hoping that I could file earlier, but the things are a bit shaky now because I have just started a sole proprietorship and that was risky enough.
